                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Article 2 of Chapter 2 of Title 32 of the Official 
  1- 2  Code of Georgia Annotated, relating to the State 
  1- 3  Transportation Board, so as to change the terms of office of 
  1- 4  members of such board; to provide for the completion of 
  1- 5  terms by certain members; to make an editorial change; to 
  1- 6  provide for a contingent effective date and for automatic 
  1- 7  repeal; to repeal conflicting laws; and for other purposes. 
 
  1- 8       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 9                           SECTION 1. 
 
  1-10  Article 2 of Chapter 2 of Title 32 of the Official Code of 
  1-11  Georgia Annotated, relating to the State Transportation 
  1-12  Board, is amended by striking in its entirety subsection (b) 
  1-13  of Code Section 32-2-20, relating to members of the board 
  1-14  and their qualifications, terms, selection, vacancies, 
  1-15  officers, meetings, and compensation, and inserting in its 
  1-16  place the following: 
 
  1-17    "(b) Each member shall be elected to serve for a term of 
  1-18    five three years and until his or her successor is duly 
  1-19    elected and certified.  Members in office on January 1, 
  1-20    2000 or persons elected to fill vacancies among such 
  1-21    members shall complete the terms for which they were 
  1-22    elected. The member of the board from each congressional 
  1-23    district shall be elected by a majority vote of the 
  1-24    members of the House of Representatives and Senate whose 
  1-25    respective districts are embraced or partly embraced 
  1-26    within such congressional district, meeting in caucus at 
  1-27    the regular session of the General Assembly immediately 
  1-28    preceding the expiration of the term of office of each 
  1-29    such board member.  Said caucus shall be called at the 
  1-30    state capitol by the Speaker of the House of 
  1-31    Representatives and the President of the Senate within the 
  1-32    first ten days of the convening of the General Assembly in 
  1-33    regular session by mailing to the members of the General 
  1-34    Assembly who are affected written notice at least four 
  1-35    days before the caucus, which notice shall state the time,

  2- 1    place, and purpose of said caucus.  Within 15 days after 
  2- 2    each such election, the Speaker of the House and the 
  2- 3    President of the Senate shall jointly transmit a 
  2- 4    certificate of such election to the Secretary of State 
  2- 5    who, upon receipt thereof, shall immediately issue his or 
  2- 6    her commission thereon, with the great seal of the state 
  2- 7    affixed thereto." 
 
  2- 8                           SECTION 2. 
 
  2- 9  This Act shall become effective January 1, 2001, only if a 
  2-10  proposed amendment to the Constitution authorizing the 
  2-11  General Assembly to determine by law the term of office for 
  2-12  members of the State Transportation Board is ratified by the 
  2-13  voters at the general election in November, 2000.  Otherwise 
  2-14  this Act shall be void and of no effect and shall be 
  2-15  automatically repealed on January 1, 2001. 
 
  2-16                           SECTION 3. 
 
  2-17  All laws and parts of laws in conflict with this Act are
