A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 12-5-31 of the Official Code of
1- 2 Georgia Annotated, relating to permits for the withdrawal,
1- 3 diversion, or impoundment of surface water, so as to
1- 4 prohibit acceptance, processing, or granting of any
1- 5 application for a permit for any applicant who uses or
1- 6 proposes to use aquifer storage or recovery of surface
1- 7 water; to prohibit diversion, recharging, or placing water
1- 8 withdrawn pursuant to a permit into any aquifer; to provide
1- 9 for a definition; to provide for automatic repeal; to repeal
1-10 conflicting laws; and for other purposes.
1-11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-12 SECTION 1.
1-13 Code Section 12-5-31 of the Official Code of Georgia
1-14 Annotated, relating to permits for the withdrawal,
1-15 diversion, or impoundment of surface water, is amended by
1-16 inserting at the end thereof the following:
1-17 "(p) The director shall not accept, process, or grant any
1-18 application for a permit for surface-water withdrawal,
1-19 diversion, or impoundment for any applicant who uses or
1-20 proposes to use aquifer storage or recovery of surface
1-21 water. No water withdrawn pursuant to a permit obtained
1-22 under this Code section shall be diverted, recharged, or
1-23 otherwise placed into any aquifer. For the purposes of
1-24 this subsection, the term 'aquifer' shall have the meaning
1-25 set out in Code Section 12-5-92. This subsection shall be
1-26 automatically repealed December 31, 2005."
1-27 SECTION 2.
1-28 All laws and parts of laws in conflict with this Act are
1-29 repealed.
