change the definition of such offense to include any person who
intentionally escapes from a facility housing persons convicted
of crimes or violations of municipal ordinances operated by a
private entity pursuant to a contract with the state, a county,
or municipal corporation; and for other purposes.

A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 16-10-52 of the Official Code of
1- 2 Georgia Annotated, relating to the offense of escape, so as
1- 3 to change the definition of such offense to include any
1- 4 person who intentionally escapes from a facility housing
1- 5 persons convicted of crimes or violations of municipal
1- 6 ordinances operated by a private entity pursuant to a
1- 7 contract with the state, a county, or municipal corporation;
1- 8 to provide an effective date; to repeal conflicting laws;
1- 9 and for other purposes.
1-10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-11 SECTION 1.
1-12 Code Section 16-10-52 of the Official Code of Georgia
1-13 Annotated, relating to the offense of escape, is amended by
1-14 striking in its entirety paragraph (1) of subsection (a) and
1-15 inserting in lieu thereof a new paragraph (1) to read as
1-16 follows:
1-17 "(1) Having been convicted of a felony or misdemeanor or
1-18 of the violation of a municipal ordinance, intentionally
1-19 escapes from lawful custody or from any place of lawful
1-20 confinement, including a facility housing persons
1-21 convicted of crimes or violations of municipal
1-22 ordinances operated by a private entity pursuant to a
1-23 contract with the state, a county, or a municipal
1-24 corporation;"
1-25 SECTION 2.
1-26 This Act shall become effective upon its approval by the
1-27 Governor or upon its becoming law without such approval.
1-28 SECTION 3.
1-29 All laws and parts of laws in conflict with this Act are
1-30 repealed.
