                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Article 1 of Chapter 18 of Title 45 of the Official 
  1- 2  Code of Georgia Annotated, relating to the state employees' 
  1- 3  health insurance plan, so as to provide that the Board of 
  1- 4  Community Health is authorized to contract with the 
  1- 5  Georgia-Federal State Inspection Service for inclusion in 
  1- 6  such plan of state employees and retiring employees of such 
  1- 7  service and their spouses and dependent children; to change 
  1- 8  certain provisions relating to continuation of coverage 
  1- 9  under the state health insurance plan for spouses or 
  1-10  dependents of deceased employees; to repeal conflicting 
  1-11  laws; and for other purposes. 
 
  1-12       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-13                           SECTION 1. 
 
  1-14  Article 1 of Chapter 18 of Title 45 of the Official Code of 
  1-15  Georgia Annotated, relating to the state employees' health 
  1-16  insurance plan, is amended by inserting immediately 
  1-17  following Code Section 45-18-7.5 a new Code section to read 
  1-18  as follows: 
 
  1-19    "45-18-7.6. 
 
  1-20    The board is authorized to contract with the 
  1-21    Georgia-Federal State Inspection Service for the inclusion 
  1-22    in any health insurance plan or plans established under 
  1-23    this article of the state employees and retiring employees 
  1-24    of the Georgia-Federal State Inspection Service  and their 
  1-25    spouses and dependent children, as defined by the 
  1-26    regulations of the board. It shall be the duty of the 
  1-27    Georgia-Federal State Inspection Service to deduct from 
  1-28    the salary or other remuneration or otherwise collect such 
  1-29    payment from its qualified employees, retired employees, 
  1-30    or dependents as may be required under the board's 
  1-31    regulations. In addition, it shall be the duty of the 
  1-32    Georgia-Federal State Inspection Service to make the 
  1-33    employer contributions required for the operation of such 
  1-34    plan or plans."

  2- 1                           SECTION 2. 
 
  2- 2  Said article is further amended by adding to Code Section 
  2- 3  45-18-9, relating to continuation of coverage under the 
  2- 4  state health insurance plan for spouses or dependents of 
  2- 5  deceased employees, a new subsection (e) to read as follows: 
 
  2- 6    "(e) If any employee of this state is killed while acting 
  2- 7    within the scope of his or her employment or receives 
  2- 8    bodily injury while acting within the scope of his or her 
  2- 9    employment that directly results in death thereafter, 
  2-10    eligible dependents may continue coverage, provided that: 
 
  2-11      (1) The deceased employee was the primary or principal 
  2-12      beneficiary of any contract or contracts for health 
  2-13      insurance established under this article; 
 
  2-14      (2) At the time of death, the employee included his or 
  2-15      her eligible dependents under such contract or contracts 
  2-16      for health insurance; 
 
  2-17      (3) At the time of death, the employee maintained 
  2-18      continuous coverage during the period between injury and 
  2-19      death; 
 
  2-20      (4) The eligible dependents agree to pay the 
  2-21      contributions to the cost of such coverage; and 
 
  2-22      (5) The eligible dependents pay such contributions in 
  2-23      accordance with the rules and regulations promulgated 
  2-24      and adopted by the board governing the continuance, 
  2-25      discontinuance, and resumption of coverage by such 
  2-26      eligible dependents." 
 
  2-27                           SECTION 3. 
 
  2-28  All laws and parts of laws in conflict with this Act are
