                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Part 1 of Article 8 of Chapter 1 of Title 10 of the 
  1- 2  Official Code of Georgia Annotated, relating to sale of 
  1- 3  petroleum products and related products, so as to prescribe 
  1- 4  maximum sulfur content for motor vehicle gasoline and motor 
  1- 5  vehicle diesel fuel; to provide for certain contingencies; 
  1- 6  to provide for certain investigation and reporting by the 
  1- 7  Environmental Protection Division of the Department of 
  1- 8  Natural Resources; to provide for related matters; to repeal 
  1- 9  conflicting laws; and for other purposes. 
 
  1-10       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-11                           SECTION 1. 
 
  1-12  Part 1 of Article 8 of Chapter 1 of Title 10 of the Official 
  1-13  Code of Georgia Annotated, relating to sale of petroleum 
  1-14  products and related products, is amended by adding 
  1-15  immediately after Code Section 10-1-555 a new Code section 
  1-16  to read as follows: 
 
  1-17    "10-1-555.1. 
 
  1-18    (a) Subject to subsection (b) of this Code section, 
  1-19    beginning October 1, 2002, a person may not manufacture, 
  1-20    sell, or offer for sale motor vehicle gasoline that 
  1-21    contains a concentration of sulfur that is greater than 40 
  1-22    parts per million per gallon of gasoline. 
 
  1-23    (b) A person may not be deemed to be in violation of 
  1-24    subsection (a) of this Code section if: 
 
  1-25      (1) The person manufactures, sells, or offers for sale 
  1-26      during any one-year period motor vehicle gasoline that 
  1-27      contains a concentration of sulfur that is not greater 
  1-28      than 80 parts per million per gallon of gasoline; and 
 
  1-29      (2) The average concentration of sulfur in the motor 
  1-30      vehicle gasoline manufactured, sold, or offered for sale 
  1-31      by the person during the one-year period is less than 30 
  1-32      parts per million per gallon of gasoline.

  2- 1    (c) A person may not manufacture, sell, or offer for sale 
  2- 2    motor vehicle diesel fuel that contains a concentration of 
  2- 3    sulfur that is greater than 50 parts per million after the 
  2- 4    sooner of: 
 
  2- 5      (1) October 1, 2005; or 
 
  2- 6      (2) October 1 of the year that the Environmental 
  2- 7      Protection Division of the Department of Natural 
  2- 8      Resources reports to the General Assembly that the motor 
  2- 9      vehicle manufacturers have introduced a significant 
  2-10      number of diesel-powered sports utility vehicles, 
  2-11      minivans, and light trucks into a market that was 
  2-12      previously dominated by gasoline-powered sports utility 
  2-13      vehicles, minivans, and light trucks. 
 
  2-14    (d) The requirements of subsections (a) through (c) of 
  2-15    this Code section shall be contingent on the Environmental 
  2-16    Protection Division determining and declaring by rule that 
  2-17    such requirements may be enforced in conformity with 
  2-18    Section 211(C)(4) of the federal Clean Air Act, 42 U.S.C. 
  2-19    Section 7545(c)(4). 
 
  2-20    (e) The Commissioner of Agriculture shall in consultation 
  2-21    with the Environmental Protection Division adopt 
  2-22    regulations to implement the requirements of this Code 
  2-23    section. 
 
  2-24    (f) In consultation with the United States Environmental 
  2-25    Protection Agency, the Environmental Protection Division 
  2-26    shall report to the General Assembly by January 1, 2002, 
  2-27    on the potential benefits to urban and regional air 
  2-28    quality of establishing maximum and average allowable 
  2-29    sulfur concentrations for gasoline that are lower than the 
  2-30    concentration limitations specified in this Code section. 
 
  2-31    (g) Beginning January 1, 2000, and each year thereafter, 
  2-32    the Environmental Protection Division shall submit an 
  2-33    annual report to the General Assembly on the transition in 
  2-34    the motor vehicle manufacturing industry to using diesel 
  2-35    engines in place of gasoline engines in sports utility 
  2-36    vehicles, minivans, and light trucks." 
 
  2-37                           SECTION 2. 
 
  2-38  All laws and parts of laws in conflict with this Act are 
  2-39  repealed.
