                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To create the Smyrna Revitalization Authority; to provide 
  1- 2  for the duties, membership, appointment of members, 
  1- 3  qualifications, terms of office, rules of operation, 
  1- 4  officers, compensation, and staff and professional services 
  1- 5  for such authority; to provide that the authority is not 
  1- 6  authorized to issue bonds or levy taxes, fees, or 
  1- 7  assessments; to authorize acceptance and use of gifts, 
  1- 8  donations, or grants; to  provide for annual 
  1- 9  recommendations; to repeal conflicting laws, and for other 
  1-10  purposes. 
 
  1-11       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-12                           SECTION 1. 
 
  1-13  There is created the Smyrna Revitalization Authority.  The 
  1-14  authority shall research, compile information, and make an 
  1-15  annual list of recommendations to the Smyrna City Council on 
  1-16  tactics to revitalize blighted business corridors. The first 
  1-17  such recommendations shall be presented to the Smyrna City 
  1-18  Council on or about March 1, 2001, and annually thereafter. 
 
  1-19                           SECTION 2. 
 
  1-20  (a) The authority shall be composed of nine members 
  1-21  appointed as follows: 
 
  1-22      (1) One member shall be appointed by the mayor of 
  1-23      Smyrna; 
 
  1-24      (2) Four members shall be appointed by majority vote of 
  1-25      the members of the City Council of Smyrna; 
 
  1-26      (3) Two members shall be appointed by a majority vote of 
  1-27      the members of the Georgia House of Representatives who 
  1-28      represent any part of the City of Smyrna; and 
 
  1-29      (4) Two members shall be appointed by a majority vote of 
  1-30      the members of the Georgia Senate who represent any part 
  1-31      of the City of Smyrna. 
 
  1-32  (b) Each member of the authority shall:

  2- 1      (1) Be a resident of the City of Smyrna; 
 
  2- 2      (2) Own a business located in the City of Smyrna; 
 
  2- 3      (3) Own real property located in the City of Smyrna; or 
 
  2- 4      (4) Work in the City of Smyrna. 
 
  2- 5  (c) No person who is the holder of an elective public office 
  2- 6  or a candidate for an elective public office shall be 
  2- 7  eligible for membership on the authority.  Any member who 
  2- 8  qualifies as a candidate for elective office shall be 
  2- 9  ineligible to complete his or her term of office as a member 
  2-10  of the authority. 
 
  2-11                           SECTION 3. 
 
  2-12  (a) The members of the authority shall serve for terms of 
  2-13  two years and may be reappointed to serve successive terms 
  2-14  on the authority. 
 
  2-15  (b) Meetings of the authority shall be conducted in 
  2-16  accordance with Robert's Rules of Order. 
 
  2-17  (c) The authority shall elect officers, including a 
  2-18  chairperson, vice chairperson, and secretary.  No member may 
  2-19  serve more than two successive terms as chairperson. 
 
  2-20  (d) Members of the authority are authorized to provide for 
  2-21  compensation, not to exceed $25.00 monthly, by majority vote 
  2-22  of the authority. 
 
  2-23                           SECTION 4. 
 
  2-24  The authority is authorized to hire staff and to contract 
  2-25  for professional services at its discretion. 
 
  2-26                           SECTION 5. 
 
  2-27  The authority is not authorized to issue bonds or to levy 
  2-28  taxes, fees, or assessments. 
 
  2-29                           SECTION 6. 
 
  2-30  The authority is authorized to accept gifts, donations, and 
  2-31  grants from any public or private source and to use such 
  2-32  funds or in-kind donations to accomplish the purposes of 
  2-33  this Act. 
 
  2-34                           SECTION 7. 
 
  2-35  This Act shall become effective upon its approval by the 
  2-36  Governor or upon its becoming law without such approval.

  3- 1                           SECTION 8. 
 
  3- 2  All laws and parts of laws in conflict with this Act are
