                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 17-6-71 of the Official Code of 
  1- 2  Georgia Annotated, relating to forfeiture of bail bonds, so 
  1- 3  as to provide for suspension of certain bondspersons who 
  1- 4  fail to satisfy a bond forfeiture judgment; to provide for 
  1- 5  reinstatement; to repeal conflicting laws; and for other 
  1- 6  purposes. 
 
  1- 7       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 8                           SECTION 1. 
 
  1- 9  Code Section 17-6-71 of the Official Code of Georgia 
  1-10  Annotated, relating to forfeiture of bail bonds, is amended 
  1-11  by inserting new subsections, to be designated subsections 
  1-12  (c) and (d), to read as follows: 
 
  1-13    "(c) Any professional bondsperson or person acting as a 
  1-14    surety on an appearance bail bond who fails to satisfy any 
  1-15    bond forfeiture judgment absolute entered by a court of 
  1-16    competent jurisdiction within 120 days after issuance of 
  1-17    such bond forfeiture judgment absolute shall be suspended 
  1-18    by the sheriff regulating such bondsperson's authority to 
  1-19    act as a commercial surety on appearance bail bonds.  This 
  1-20    provision shall apply to any bond forfeiture judgment 
  1-21    absolute entered by any superior court, state court, 
  1-22    probate court, magistrate court, or municipal court. 
 
  1-23    (d) The sheriff regulating commercial bail bondspersons 
  1-24    may reinstate such suspended professional bail 
  1-25    bondsperson's authority to act as a commercial surety on 
  1-26    an appearance bail bond upon proof of satisfaction of any 
  1-27    unpaid bond forfeiture judgments." 
 
  1-28                           SECTION 2. 
 
  1-29  All laws and parts of laws in conflict with this Act are 
  1-30  repealed.
