A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Chapter 60 of Title 36 of the Official Code of
1- 2 Georgia Annotated, relating to general provisions applicable
1- 3 to counties and municipal corporations, so as to prevent
1- 4 counties and cities from prohibiting businesses from
1- 5 locating advertising banners or portable signs on their
1- 6 business premises; to provide for definitions; to provide
1- 7 for certain limitations and restrictions; to provide that
1- 8 counties and cities may regulate in a manner not
1- 9 inconsistent with the general law; to provide for related
1-10 matters; to repeal conflicting laws; and for other purposes.
1-11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-12 SECTION 1.
1-13 Chapter 60 of Title 36 of the Official Code of Georgia
1-14 Annotated, relating to general provisions applicable to
1-15 counties and municipal corporations, is amended by adding at
1-16 the end thereof a new Code section to read as follows:
1-17 "36-60-22.
1-18 (a) As used in the Code section, the term:
1-19 (1) 'Advertising banner' means a sign printed or drawn
1-20 on a piece of fabric or plastic not to exceed five feet
1-21 by ten feet and mounted on the physical premises of a
1-22 business in a way that does not interfere with public
1-23 safety or the view by the public of any other business.
1-24 The term advertising banner specifically excludes
1-25 'outdoor advertising' as such term is defined in
1-26 paragraph (14) of Code Section 32-6-71.
1-27 (2) 'Business' means any enterprise lawfully operating
1-28 within a county or municipality.
1-29 (3) 'Portable sign' means a sign mounted on a trailer or
1-30 other vehicle which is lawfully parked on property of a
1-31 business or in a parking area designated for customers
1-32 of such business, provided that such sign does not
1-33 exceed five feet by ten feet and is not located in such

2- 1 a way as to interfere with public safety or prevent
2- 2 customers from viewing any other business. The term
2- 3 portable sign specifically excludes 'outdoor
2- 4 advertising' as such term is defined in paragraph (14)
2- 5 of Code Section 32-6-71.
2- 6 (b) A county or municipality may not prohibit a business
2- 7 from installing permanent or temporary advertising banners
2- 8 or portable signs. A county or municipality may, however,
2- 9 further regulate the placement and size of advertising
2-10 banners and portable signs in a manner not inconsistent
2-11 with this Code section."
2-12 SECTION 2.
2-13 All laws and parts of laws in conflict with this Act are
2-14 repealed.
