A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Part 2 of Article 15 of Chapter 1 of Title 10 of
1- 2 the Official Code of Georgia Annotated, the "Fair Business
1- 3 Practices Act of 1975," so as to provide that it shall be an
1- 4 unfair business practice to discriminate against a person
1- 5 based on his or her gender in the pricing of goods or
1- 6 services; to repeal conflicting laws; and for other
1- 7 purposes.
1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 9 SECTION 1.
1-10 Part 2 of Article 15 of Chapter 1 of Title 10 of the
1-11 Official Code of Georgia Annotated, the "Fair Business
1-12 Practices Act of 1975," is amended by inserting immediately
1-13 following Code Section 10-1-393.4 a new Code section to read
1-14 as follows:
1-15 "10-1-393.7.
1-16 (a) It shall be an unlawful, unfair, and deceptive trade
1-17 practice to discriminate, with respect to the price
1-18 charged for goods or services of similar type or kind,
1-19 against a person because of such person's gender.
1-20 (b) Nothing in subsection (a) of this Code section shall
1-21 be construed so as to prohibit price differences based
1-22 specifically upon the amount of time, difficulty, or cost
1-23 of producing the goods or providing the services."
1-24 SECTION 2.
1-25 All laws and parts of laws in conflict with this Act are
1-26 repealed.
