                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Chapter 1 of Title 35 of the Official Code of 
  1- 2  Georgia Annotated, relating to general provisions applicable 
  1- 3  to law enforcement officers and agencies, so as to authorize 
  1- 4  a police chief of a local law enforcement agency with the 
  1- 5  approval of the local governing authority to designate and 
  1- 6  equip police volunteers and to provide training to such 
  1- 7  police volunteers in the area and manner of traffic control; 
  1- 8  to provide that under certain circumstances police 
  1- 9  volunteers shall be authorized to direct and regulate the 
  1-10  flow of traffic during emergencies; to provide that police 
  1-11  volunteers shall not have the power of arrest provided to 
  1-12  peace officers; to amend Article 1 of Chapter 6 of Title 40 
  1-13  of the Official Code of Georgia Annotated, relating to 
  1-14  general provisions applicable to uniform rules of the road, 
  1-15  so as to change the provisions relating to obedience to 
  1-16  authorized persons directing traffic; to repeal conflicting 
  1-17  laws; and for other purposes. 
 
  1-18       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-19                           SECTION 1. 
 
  1-20  Chapter 1 of Title 35 of the Official Code of Georgia 
  1-21  Annotated, relating to general provisions applicable to law 
  1-22  enforcement officers and agencies, is amended by adding at 
  1-23  the end of said chapter a new Code Section 35-1-11 to read 
  1-24  as follows: 
 
  1-25    "35-1-11. 
 
  1-26    A police chief of a local law enforcement agency with the 
  1-27    approval of the local governing authority shall be 
  1-28    authorized to designate and equip police volunteers and to 
  1-29    provide training to such police volunteers in the area and 
  1-30    manner of traffic control.  With the approval of the 
  1-31    police chief of a local law enforcement agency or fire 
  1-32    chief of a local fire department, a police volunteer shall 
  1-33    be authorized to direct and regulate the flow of traffic 
  1-34    in the event of a fire, explosion, hurricane, tornado, or

  2- 1    other emergency situation. A police volunteer shall not 
  2- 2    have the power of arrest provided to peace officers." 
 
  2- 3                           SECTION 2. 
 
  2- 4  Article 1 of Chapter 6 of Title 40 of the Official Code of 
  2- 5  Georgia Annotated, relating to general provisions applicable 
  2- 6  to uniform rules of the road, is amended by striking in its 
  2- 7  entirety Code Section 40-6-2, relating to obedience to 
  2- 8  authorized persons directing traffic, and inserting in lieu 
  2- 9  thereof a new Code Section 40-6-2 to read as follows: 
 
  2-10    "40-6-2. 
 
  2-11    No person shall fail or refuse to comply with any lawful 
  2-12    order or direction of any police officer, fireman, police 
  2-13    volunteer authorized under Code Section 35-1-11, or 
  2-14    school-crossing guard designated by a local law 
  2-15    enforcement agency invested by law with authority to 
  2-16    direct, control, or regulate traffic." 
 
  2-17                           SECTION 3. 
 
  2-18  All laws and parts of laws in conflict with this Act are
