                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend an Act providing a new charter for the City of 
  1- 2  Offerman, approved April 2, 1996 (Ga. L. 1996, p. 3950), so 
  1- 3  as to change the provisions relating to the election and 
  1- 4  terms of office of the mayor and councilmembers; to provide 
  1- 5  for initial and regular terms of office; to provide for 
  1- 6  municipal elections; to repeal conflicting laws; and for 
  1- 7  other purposes. 
 
  1- 8       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 9                           SECTION 1. 
 
  1-10  An Act providing a new charter for the City of Offerman, 
  1-11  approved April 2, 1996 (Ga. L. 1996, p. 3950), is amended by 
  1-12  striking Section 2.11 and inserting in its place the 
  1-13  following: 
 
  1-14                         "SECTION 2.11. 
  1-15                   City councilmembers; terms 
  1-16                 and qualifications for office. 
 
  1-17    Except as otherwise provided in Section 5.11 of this Act, 
  1-18    the members of the city council shall serve for terms of 
  1-19    four years and until their respective successors are 
  1-20    elected and qualified.  No person shall be eligible to 
  1-21    serve as mayor or councilmember unless that person shall 
  1-22    have been a resident of the city immediately prior to the 
  1-23    date of the election of mayor or members of the city 
  1-24    council for one year; each shall continue to reside 
  1-25    therein during that person's period of service and to be 
  1-26    registered and qualified to vote in municipal elections of 
  1-27    this city." 
 
  1-28                           SECTION 2. 
 
  1-29  Said Act is further amended by striking Section 2.26 and 
  1-30  inserting in its place the following: 
 
  1-31                         "SECTION 2.26. 
  1-32          Election of mayor; forfeiture; compensation.

  2- 1    Except as otherwise provided in Section 5.11 of this Act, 
  2- 2    the mayor shall be elected and shall serve for a term of 
  2- 3    four years and until the mayor's successor is elected and 
  2- 4    qualified.  The mayor shall be a qualified elector of this 
  2- 5    city and shall have been a resident of the city 
  2- 6    immediately preceding the mayor's election for a period of 
  2- 7    no less than one year.  The mayor shall continue to reside 
  2- 8    in this city during the period of the mayor's service. 
  2- 9    Then mayor shall forfeit the office of mayor on the same 
  2-10    grounds and under the same procedure as for 
  2-11    councilmembers.  The compensation of the mayor shall be 
  2-12    established in the same manner as for councilmembers." 
 
  2-13                           SECTION 3. 
 
  2-14  Said Act is further amended by striking Section 5.11 and 
  2-15  inserting in its place the following: 
 
  2-16                         "SECTION 5.11. 
  2-17            Election of the city council and mayor. 
 
  2-18    (a) There shall be a municipal general election on the 
  2-19    Tuesday next following the first Monday in November, 2000. 
  2-20    At such election the mayor and councilmembers for Posts 2, 
  2-21    4, and 6 shall be elected.  The officials elected at such 
  2-22    election shall take office on the first day of January, 
  2-23    2001, for an initial term of three years and until their 
  2-24    respective successors are elected and qualified. 
 
  2-25    (b) There shall be a municipal general election on the 
  2-26    Tuesday next following the first Monday in November, 2001. 
  2-27    At such election the councilmembers for Posts 1, 3, and 5 
  2-28    shall be elected. The officials elected at such election 
  2-29    shall take office on the first day of January, 2002, for 
  2-30    an initial term of four years and until their respective 
  2-31    successors are elected and qualified. 
 
  2-32    (c) Following the elections specified in subsections (a) 
  2-33    and (b) of this section, there shall be a municipal 
  2-34    general election on the Tuesday next following the first 
  2-35    Monday in November in each odd-numbered year for the 
  2-36    election of the mayor and councilmembers or for the 
  2-37    councilmembers whose terms are expiring.  Persons elected 
  2-38    to such offices shall take office on the first day of 
  2-39    January following their election for a term of four years 
  2-40    and until their respective successors are elected and 
  2-41    qualified."

  3- 1                           SECTION 4. 
 
  3- 2  All laws and parts of laws in conflict with this Act are
