                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Article 6 of Chapter 8 of Title 31 of the Official 
  1- 2  Code of Georgia Annotated, relating to the Indigent Care 
  1- 3  Trust Fund, so as to provide for the deposit of certain 
  1- 4  proceeds received from the settlement of a certain lawsuit 
  1- 5  against tobacco companies into that fund and provide for the 
  1- 6  retention or return of such proceeds under certain 
  1- 7  conditions; to repeal conflicting laws; and for other 
  1- 8  purposes. 
 
  1- 9       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-10                           SECTION 1. 
 
  1-11  Article 6 of Chapter 8 of Title 31 of the Official Code of 
  1-12  Georgia Annotated, relating to the Indigent Care Trust Fund, 
  1-13  is amended by striking Code Section 31-8-153.2, relating to 
  1-14  deposit of revenues to the fund, and inserting in its place 
  1-15  the following: 
 
  1-16    "31-8-153.2. 
 
  1-17    (a) The General Assembly may provide for the dedication 
  1-18    and deposit of revenues raised from specified sources into 
  1-19    the trust fund. 
 
  1-20    (b) All revenues which are proceeds received by the state 
  1-21    from the settlement of the lawsuit filed by this state 
  1-22    against certain tobacco companies, State of Georgia, et 
  1-23    al., v. Philip Morris, Inc., et al., Civil Action # 
  1-24    E-61692, V19/246 (Fulton County Superior Court, December 
  1-25    9, 1998), shall be deposited into the trust fund.  Such 
  1-26    proceeds, if not appropriated by the end of the fiscal 
  1-27    year, shall remain in the trust fund until appropriated 
  1-28    or, if appropriated in violation of Code Section 31-8-156, 
  1-29    shall be returned to the trust fund for later 
  1-30    appropriation pursuant to this article." 
 
  1-31                           SECTION 2. 
 
  1-32  All laws and parts of laws in conflict with this Act are 
  1-33  repealed.
