A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Chapter 60 of Title 36 of the Official Code of
1- 2 Georgia Annotated, relating to general provisions relative
1- 3 to counties and municipal corporations, so as to prohibit
1- 4 the commencement of certain rock quarry operations under
1- 5 certain circumstances; to provide an effective date; to
1- 6 repeal conflicting laws; and for other purposes.
1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 8 SECTION 1.
1- 9 Chapter 60 of Title 36 of the Official Code of Georgia
1-10 Annotated, relating to general provisions relative to
1-11 counties and municipal corporations, is amended by inserting
1-12 at the end thereof the following:
1-13 "36-60-22.
1-14 Any other provision of law to the contrary
1-15 notwithstanding, if the director of the Environmental
1-16 Protection Division of the Department of Natural Resources
1-17 determines through scientific analysis that such a quarry
1-18 location might have significant impact on the water
1-19 system, no person may commence the operation of a
1-20 limestone or dolostone rock quarry located in the Ridge
1-21 and Valley Province as defined by the Physiographic Map of
1-22 Georgia, W. Z. Clark and A. C. Zisa, 1976, and within
1-23 eight miles of any well or spring accessing an underground
1-24 source of water which provides water to any county or
1-25 municipality in an amount of at least 50 percent of such
1-26 county's or municipality's water supply or two million
1-27 gallons per day, whichever is less."
1-28 SECTION 2.
1-29 This Act shall become effective upon its approval by the
1-30 Governor or upon its becoming law without such approval.

2- 2 All laws and parts of laws in conflict with this Act are
2- 3 repealed.
