A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Title 40 of the Official Code of Georgia Annotated,
1- 2 relating to motor vehicles and traffic, so as to provide
1- 3 that failure to stop for a pedestrian in a crosswalk shall
1- 4 not be treated as a traffic violation pursuant to Code
1- 5 Section 40-13-60 but rather as a misdemeanor of a high and
1- 6 aggravated nature; to repeal conflicting laws; and for other
1- 7 purposes.
1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 9 SECTION 1.
1-10 Title 40 of the Official Code of Georgia Annotated, relating
1-11 to motor vehicles and traffic, is amended by adding to Code
1-12 Section 40-6-91, relating to right of way of pedestrians in
1-13 crosswalks, a new subsection (e) to read as follows:
1-14 "(e) Violation of this Code section by the driver of a
1-15 vehicle shall be a misdemeanor of a high and aggravated
1-16 nature."
1-17 SECTION 2.
1-18 Said title is further amended by striking subsection (b) of
1-19 Code Section 40-13-53, relating to release of person
1-20 arrested for traffic violation upon service of citation and
1-21 complaint, and inserting in lieu thereof the following:
1-22 "(b) The following offenses shall not be handled or
1-23 disposed of by a traffic violations bureau:
1-24 (1) Any offense for which a driver's license may be
1-25 suspended by the commissioner of public safety;
1-26 (2) Any motor vehicle registration violation;
1-27 (3) A violation of Code Section 40-5-20;
1-28 (3.1) Failure to stop for a pedestrian in a crosswalk in
1-29 violation of Code Section 40-6-91;
1-30 (4) Speeding in excess of 30 miles per hour over the
1-31 posted speed limit; or

2- 1 (5) Any offense which would otherwise be a traffic
2- 2 violations bureau offense but which arose out of the
2- 3 same conduct or occurred in conjunction with an offense
2- 4 which is excluded from the jurisdiction of the traffic
2- 5 violations bureau. Any such offense shall be subject to
2- 6 the maximum punishment set by law."
2- 7 SECTION 3.
2- 8 All laws and parts of laws in conflict with this Act are
2- 9 repealed.
