A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Part 13 of Article 6 of Chapter 2 of Title 20 of
1- 2 the Official Code of Georgia Annotated, relating to the
1- 3 organization of schools and school systems, so as to require
1- 4 local boards of education to adopt policies permitting
1- 5 parents or guardians of resident students to select a school
1- 6 of their choice within the school system, subject to certain
1- 7 limitations; to provide for related matters; to provide for
1- 8 an effective date; to repeal conflicting laws; and for other
1- 9 purposes.
1-10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-11 SECTION 1.
1-12 Part 13 of Article 6 of Chapter 2 of Title 20 of the
1-13 Official Code of Georgia Annotated, relating to the
1-14 organization of schools and school systems, is amended by
1-15 adding at the end thereof a new Code Section 20-2-294 to
1-16 read as follows:
1-17 "20-2-294.
1-18 The board of education for each local school system shall
1-19 adopt policies that permit the parent or guardian of any
1-20 eligible child or youth who resides in the local school
1-21 system to enroll such child or youth in a particular
1-22 school, which is located within that school system, of
1-23 that parent or guardian's choice. Such local policies may
1-24 limit the parent or guardian's ability to select a
1-25 particular school based upon the capacity of a program,
1-26 class, grade level, or school building or such other
1-27 factors as the local board finds appropriate. The parent
1-28 or guardian of any child or youth who attends a school of
1-29 choice pursuant to local policies adopted under this Code
1-30 section shall provide transportation to such school for
1-31 his or her child or ward."
1-32 SECTION 2.
1-33 This Act shall become effective on July 1, 1999.

2- 2 All laws and parts of laws in conflict with this Act are
2- 3 repealed.
