A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Article 3 of Chapter 2 of Title 40 of the Official
1- 2 Code of Georgia Annotated, relating to prestige license
1- 3 plates, so as to provide for a prestige license plate for
1- 4 United States armed forces Georgia veterans; to provide for
1- 5 procedures, conditions, and limitations; to provide for
1- 6 powers, duties, and authority of the state revenue
1- 7 commissioner and county tag agents; to provide for an
1- 8 effective date; to repeal conflicting laws; and for other
1- 9 purposes.
1-10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-11 SECTION 1.
1-12 Article 3 of Chapter 2 of Title 40 of the Official Code of
1-13 Georgia Annotated, relating to prestige license plates, is
1-14 amended by adding a new Code section at the end thereof, to
1-15 be designated Code Section 40-2-86.5, to read as follows:
1-16 "40-2-86.5.
1-17 (a) Motor vehicle owners who are Georgia veterans of the
1-18 armed forces of the United States shall be eligible to
1-19 receive special and distinctive vehicle license plates for
1-20 private passenger cars, trucks, or recreational vehicles
1-21 used for personal transportation. Such license plates
1-22 shall be issued in compliance with the state motor vehicle
1-23 laws relating to registration and licensing of motor
1-24 vehicles as prescribed in Article 2 of this chapter.
1-25 (b) A veteran who qualifies for the special and
1-26 distinctive license plate pursuant to subsection (a) of
1-27 this Code section shall make application therefor with the
1-28 commissioner and include the requisite fee. The
1-29 commissioner shall design a distinctive license plate to
1-30 commemorate service by Georgia veterans of the United
1-31 States armed forces. The commissioner shall promulgate
1-32 such rules and regulations as may be necessary to enforce
1-33 compliance with all state license laws relating to the use
1-34 and operation of private passenger cars and trucks before

2- 1 issuing these license plates in lieu of the regular
2- 2 Georgia license plates. The manufacturing fee for such
2- 3 special and distinctive license plates shall be $25.00.
2- 4 The commissioner is specifically authorized to promulgate
2- 5 all rules and regulations necessary to ensure compliance
2- 6 in instances where such vehicles have been transferred or
2- 7 sold. Except as provided in subsection (d) of this Code
2- 8 section, such plates shall be nontransferable.
2- 9 (c) The special and distinctive vehicle license plates
2-10 shall be as prescribed in Article 2 of this chapter for
2-11 private passenger cars or trucks used for personal
2-12 transportation. Such plates shall contain such words or
2-13 symbols, in addition to the numbers and letters prescribed
2-14 by law, so as to identify distinctively the owners as
2-15 Georgia veterans of the armed forces of the United States.
2-16 (d) The license plate issued pursuant to this Code section
2-17 shall be transferred between vehicles as provided in Code
2-18 Section 40-2-80. The spouse of a deceased Georgia veteran
2-19 of the armed forces of the United States shall continue to
2-20 be eligible to be issued a distinctive personalized
2-21 license plate as provided in this Code section for any
2-22 vehicle owned by such veteran ownership of which is
2-23 transferred to the surviving spouse or for any other
2-24 vehicle owned by such surviving spouse either at the time
2-25 of the qualifying veteran's death or acquired thereafter,
2-26 so long as such person does not remarry.
2-27 (e) Special license plates issued under this Code section
2-28 shall be renewed annually with a revalidation decal as
2-29 provided in Code Section 40-2-31 upon payment of an
2-30 additional $25.00 annual registration fee, which fee shall
2-31 be collected by the county tag agent at the time of
2-32 collection of other registration fees and remitted to the
2-33 state as provided in Code Section 40-2-34. It shall be a
2-34 requirement that a county name decal shall be affixed and
2-35 displayed on license plates issued under this Code
2-36 section."
2-37 SECTION 2.
2-38 This Act shall become effective on January 1, 2000.
2-39 SECTION 3.
2-40 All laws and parts of laws in conflict with this Act are
2-41 repealed.
