A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 4-8-22 of the Official Code of Georgia
1- 2 Annotated, relating to the powers of local governments to
1- 3 enforce certain requirements relating to the control of
1- 4 dangerous dogs, so as to delete a restriction against a
1- 5 member of an animal control board participating in a hearing
1- 6 regarding a dog where the member had previously participated
1- 7 in the classification of that dog as a potentially dangerous
1- 8 dog or dangerous dog; to provide for an effective date and
1- 9 applicability; to repeal conflicting laws; and for other
1-10 purposes.
1-11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-12 SECTION 1.
1-13 Code Section 4-8-22 of the Official Code of Georgia
1-14 Annotated, relating to the powers of local governments to
1-15 enforce certain requirements relating to the control of
1-16 dangerous dogs, is amended by striking in its entirety
1-17 subsection (d) and inserting in lieu thereof a new
1-18 subsection (d) to read as follows:
1-19 "(d) The governing authority of a local government may
1-20 provide by ordinance or resolution for the creation of an
1-21 animal control board to hold hearings provided for in Code
1-22 Section 4-8-24. If such an animal control board is
1-23 created, such board may hear and determine matters
1-24 provided for in Code Section 4-8-24. No member of the
1-25 animal control board may participate in a hearing on any
1-26 matter in which such member previously participated in the
1-27 classification of the dog at issue. An animal control
1-28 board may be created jointly by two or more local
1-29 governments under the provisions of subsection (b) of this
1-30 Code section."
1-31 SECTION 2.
1-32 This Act shall become effective upon its approval by the
1-33 Governor or upon its becoming law without such approval, and
1-34 shall apply to hearings held on or after that date.

2- 1 SECTION 3.
2- 2 All laws and parts of laws in conflict with this Act are
2- 3 repealed.
