                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend an Act providing authority for members of the Board 
  1- 2  of Education of Barrow County, approved April 19, 1971 (Ga. 
  1- 3  L. 1971, p. 3919), as amended, particularly by an Act 
  1- 4  approved March 23, 1992 (Ga. L. 1992, p. 4961), so as to 
  1- 5  provide for redistricting; to define certain terms; to 
  1- 6  provide for continuation in office of persons serving as 
  1- 7  members of the board on a certain date; to provide for 
  1- 8  related matters; to provide for submission of this Act to 
  1- 9  the United States Attorney General; to repeal this Act in 
  1-10  the event of a certain contingency; to repeal conflicting 
  1-11  laws; and for other purposes. 
 
  1-12       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-13                           SECTION 1. 
 
  1-14  An Act providing authority for members of the Board of 
  1-15  Education of Barrow County, approved April 19, 1971 (Ga. L. 
  1-16  1971, p. 3919), as amended, particularly by an Act approved 
  1-17  March 23, 1992 (Ga. L. 1992, p. 4961), is amended by 
  1-18  striking subsection (b) of Section 2 and inserting in lieu 
  1-19  thereof the following: 
 
  1-20        "(b)(1)(A) For purposes of electing members of the 
  1-21        Board of Education of Barrow County under this 
  1-22        section, Barrow County shall be divided into nine 
  1-23        education districts. 
 
  1-24        (B) Education Districts 1, 2, 5, 6, 8, and 9 shall 
  1-25        consist of the described territory of Barrow County 
  1-26        attached to this Act and made a part hereof and 
  1-27        further identified as 'operator: local Client: barrow 
  1-28        Plan: barrsb97', and each member representing each 
  1-29        such district shall be elected by the qualified 
  1-30        electors residing in that district only. 
 
  1-31        (C) Education Districts 3, 4, and 7 shall each be an 
  1-32        at large district, and each member representing each 
  1-33        such district shall be elected by the qualified 
  1-34        electors of the entire county.

  2- 1      (2) For purposes of this section: 
 
  2- 2        (A) The terms 'Tract,' 'Block,' and 'Block Group' 
  2- 3        shall mean and describe the same geographical 
  2- 4        boundaries as provided in the report of the Bureau of 
  2- 5        the Census for the United States decennial census of 
  2- 6        1990 for the State of Georgia; 
 
  2- 7        (B) Any part of Barrow County which is not included in 
  2- 8        any education district described in subparagraph (B) 
  2- 9        of paragraph (1) of this subsection shall be included 
  2-10        within that education district described in said 
  2-11        subparagraph which is contiguous to such part and 
  2-12        which contains the least population according to the 
  2-13        United States decennial census of 1990 for the State 
  2-14        of Georgia; and 
 
  2-15        (C) Any part of Barrow County which is described in 
  2-16        subparagraph (B) of paragraph (1) of this subsection 
  2-17        as being included in a particular education district 
  2-18        shall nevertheless not be included within such 
  2-19        education district if such part is not contiguous to 
  2-20        such education district.  Such noncontiguous part 
  2-21        shall instead be included within that education 
  2-22        district described in said subparagraph which is 
  2-23        contiguous to such part and which contains the least 
  2-24        population according to the United States decennial 
  2-25        census of 1990 for the State of Georgia." 
 
  2-26                           SECTION 2. 
 
  2-27  Said Act is further amended by striking subsection (d) of 
  2-28  Section 2 and inserting a new subsection to read as follows: 
 
  2-29      "(d)(1) The members of the board serving in office on 
  2-30      the effective date of this subsection shall continue to 
  2-31      serve until the expiration of the term for which they 
  2-32      were elected and until their successors are elected and 
  2-33      qualified. 
 
  2-34        (2)(A) All members of the board elected at or 
  2-35        subsequent to the election in 2000 shall be elected 
  2-36        from the education districts described in subsection 
  2-37        (b) of this section. 
 
  2-38        (B) Members of the board representing Education 
  2-39        Districts 2, 4, 6, and 8 shall be elected at the 
  2-40        general election in 2000 and quadrennially thereafter 
  2-41        and shall take office on the first day of January 
  2-42        immediately following their election for terms of four

  3- 1        years and until their successors are elected and 
  3- 2        qualified. 
 
  3- 3        (C) Members of the board representing Education 
  3- 4        Districts 1, 3, 5, 7, and 9 shall be elected at the 
  3- 5        general election in 2002 and quadrennially thereafter 
  3- 6        and shall take office on the first day of January 
  3- 7        immediately following their election for terms of four 
  3- 8        years and until their successors are elected and 
  3- 9        qualified." 
 
  3-10                           SECTION 3. 
 
  3-11  Pursuant to Section 5 of the federal Voting Rights Act of 
  3-12  1965, as amended, it shall be the duty of the attorney of 
  3-13  the board of education of Barrow County to submit this Act 
  3-14  to the United States Attorney General for approval.  If, as 
  3-15  of the first date upon which candidates may begin qualifying 
  3-16  for the general primary in 2000, implementation of this Act 
  3-17  is not permissible under the federal Voting Rights Act of 
  3-18  1965, as amended, then as of such date this Act shall be 
  3-19  void and stand repealed in its entirety. 
 
  3-20                           SECTION 4. 
 
  3-21  All laws and parts of laws in conflict with this Act are
