A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 47-17-80 of the Official Code of
1- 2 Georgia Annotated, relating to retirement benefit options
1- 3 under the Peace Officers' Annuity and Benefit Fund, so as to
1- 4 provide that the retirement benefit of any member of such
1- 5 fund shall not be affected if such retired member becomes
1- 6 employed as a peace officer for not more than 1,040 hours in
1- 7 any calendar year; to provide conditions for an effective
1- 8 date and automatic repeal; to repeal conflicting laws; and
1- 9 for other purposes.
1-10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-11 SECTION 1.
1-12 Code Section 47-17-80 of the Official Code of Georgia
1-13 Annotated, relating to retirement benefit options under the
1-14 Peace Officers' Annuity and Benefit Fund, is amended by
1-15 striking in its entirety paragraph (2) of subsection (g) and
1-16 inserting in lieu thereof the following:
1-17 "(2) The provisions of paragraph (1) of this subsection
1-18 shall not apply to a retired member employed in any
1-19 capacity during the period beginning July 1, 1996, and
1-20 ending June 30, 1997 for 1,040 hours or less in any
1-21 calendar year."
1-22 SECTION 2.
1-23 This Act shall become effective on July 1, 2000, only if it
1-24 is determined to have been concurrently funded as provided
1-25 in Chapter 20 of Title 47 of the Official Code of Georgia
1-26 Annotated, the "Public Retirement Systems Standards Law";
1-27 otherwise, this Act shall not become effective and shall be
1-28 automatically repealed in its entirety on July 1, 2000, as
1-29 required by subsection (a) of Code Section 47-20-50.
1-30 SECTION 3.
1-31 All laws and parts of laws in conflict with this Act are
1-32 repealed.
