A RESOLUTION
1- 1 Creating the Georgia DUI Study Commission; and for other
1- 2 purposes.
1- 3 WHEREAS, reducing and eliminating the crime of driving under
1- 4 the influence is a top concern of the citizens of Georgia;
1- 5 and
1- 6 WHEREAS, Georgians are shocked by the severity and frequency
1- 7 of the commission of this crime; and
1- 8 WHEREAS, restoring a reasonable level of public safety and
1- 9 the removal of drunken drivers from our roads should be
1-10 accepted as an all-important goal for this generation of
1-11 Americans.
1-12 NOW, THEREFORE, BE IT RESOLVED BY THE GENERAL ASSEMBLY OF
1-13 GEORGIA that there is created the Georgia DUI Study
1-14 Commission to be composed of 14 members. Eight members shall
1-15 be appointed by the Governor as follows: three members shall
1-16 be superior court judges, three members shall be district
1-17 attorneys, and two members shall be sheriffs. Three members
1-18 shall be appointed by the President of the Senate only one
1-19 of whom may be an attorney. Three members shall be appointed
1-20 by the Speaker of the House of Representatives only one of
1-21 whom may be an attorney. The President of the Senate shall
1-22 designate a member of the commission as cochairperson of the
1-23 commission. The Speaker of the House of Representatives
1-24 shall designate a member of the commission as cochairperson
1-25 of the commission. The cochairpersons shall call all
1-26 meetings of the commission.
1-27 BE IT FURTHER RESOLVED that the commission shall undertake a
1-28 study of the conditions, needs, issues, and problems
1-29 mentioned above or related thereto and recommend any actions
1-30 or legislation which the commission deems necessary or
1-31 appropriate. The commission may conduct such meetings at
1-32 such places and at such times as it may deem necessary or
1-33 convenient to enable it to exercise fully and effectively
1-34 its powers, perform its duties, and accomplish the
1-35 objectives and purposes of this resolution. The legislative
1-36 members of the commission shall receive the allowances
1-37 authorized for legislative members of interim legislative

2- 1 committees but shall receive the same for not more than five
2- 2 days unless additional days are authorized. Members of the
2- 3 commission who are not legislative members shall receive no
2- 4 compensation for their services on the commission and shall
2- 5 not be reimbursed for expenses incurred by them in the
2- 6 performance of their duties as members of the commission.
2- 7 The funds necessary to carry out the provisions of this
2- 8 resolution with respect to legislative members shall come
2- 9 from the funds appropriated to the legislative branch of
2-10 government. The commission shall make a report of its
2-11 findings and recommendations, with suggestions for proposed
2-12 legislation, if any, and such report shall be made to the
2-13 Governor and the General Assembly on or before December 15,
2-14 2000. The commission shall stand abolished on December 15,
2-15 2000.
