                             A RESOLUTION 
 
  1- 1  Creating the State Commission on Drug Addiction; and for 
  1- 2  other purposes. 
 
  1- 3  WHEREAS, drug addiction continues to wreak havoc upon the 
  1- 4  lives of many of Georgia's citizens thereby posing a threat 
  1- 5  to all of society; and 
 
  1- 6  WHEREAS, drug addiction contributes in large measure to 
  1- 7  increased crime, especially robberies and burglaries to 
  1- 8  obtain funds needed to purchase drugs; and 
 
  1- 9  WHEREAS, drug addicted mothers are unable to care adequately 
  1-10  for their children often requiring state intervention to 
  1-11  remove the children from the home because of neglect or 
  1-12  abuse; and 
 
  1-13  WHEREAS, such abuse sometimes includes the mother 
  1-14  prostituting herself and her children in order to obtain 
  1-15  drugs; and 
 
  1-16  WHEREAS, the presence of a drug addict in the family 
  1-17  seriously threatens the ability of that family to function 
  1-18  appropriately; and 
 
  1-19  WHEREAS, drug addiction among those incarcerated in the 
  1-20  state's jails, prisons, and youth detention facilities is 
  1-21  either not treated or inadequately treated to ensure the 
  1-22  incarcerated persons can avoid drug use upon their release; 
  1-23  and 
 
  1-24  WHEREAS, the state needs to develop long-range plans to deal 
  1-25  with the scourge of drug addiction without exclusively using 
  1-26  punitive measures. 
 
  1-27  NOW, THEREFORE, BE IT RESOLVED BY THE GENERAL ASSEMBLY OF 
  1-28  GEORGIA that there is created the State Commission on Drug 
  1-29  Addiction to be composed of nine members.  Two of such 
  1-30  members shall be members of the House of Representatives who 
  1-31  shall be appointed by the Speaker of the House, with one 
  1-32  being a member of the majority party in the House and one 
  1-33  being a member of the minority party in the House.  Two of 
  1-34  such members shall be members of the Senate who shall be 
  1-35  appointed by the President of the Senate, with one being a

  2- 1  member of the majority party in the Senate and one being a 
  2- 2  member of the minority party in the Senate.  Two of such 
  2- 3  members shall be appointed by the Governor who shall 
  2- 4  designate one of such appointees as chairperson and the 
  2- 5  other as vice-chairperson of the commission.  The remaining 
  2- 6  three members shall be the commissioner, or such 
  2- 7  commissioner's designee, of the following departments:  the 
  2- 8  Department of Human Resources, the Department of 
  2- 9  Corrections, and the Department of Juvenile Justice.  The 
  2-10  chairperson shall call all meetings of the commission. 
 
  2-11  BE IT FURTHER RESOLVED that the commission shall undertake a 
  2-12  study of the conditions, needs, issues, and problems 
  2-13  mentioned above or related thereto and recommend any actions 
  2-14  or legislation which the commission deems necessary or 
  2-15  appropriate.  The commission shall also collect available 
  2-16  data regarding drug addiction in order to determine: by 
  2-17  county, the number of addicts receiving treatment, according 
  2-18  to gender, treatment method, and outcome, the projected 
  2-19  number of addicts not receiving treatment, and the number of 
  2-20  arrests involving drug offenses.  The commission may conduct 
  2-21  such meetings at such places and at such times as it may 
  2-22  deem necessary or convenient to enable it to exercise fully 
  2-23  and effectively its powers, perform its duties, and 
  2-24  accomplish the objectives and purposes of this resolution. 
  2-25  Legislative members and citizen members, if any, shall 
  2-26  receive the expenses and allowances authorized by law for 
  2-27  members of legislative members of interim legislative 
  2-28  committees for their services on the commission but shall 
  2-29  receive the same for not more than ten days unless 
  2-30  additional days are authorized.  Members of the commission 
  2-31  who are state officials, other than legislative members, or 
  2-32  state employees shall receive no compensation for their 
  2-33  services on the commission, but they shall be reimbursed for 
  2-34  expenses incurred by them in the performance of their duties 
  2-35  as members of the commission.  The funds necessary for the 
  2-36  reimbursement of the expenses of state officials, other than 
  2-37  legislative members, and state employees shall come from 
  2-38  funds appropriated to or otherwise available to their 
  2-39  respective departments.  All other funds necessary to carry 
  2-40  out the provisions of this resolution shall come from the 
  2-41  funds appropriated to or otherwise available to the House of 
  2-42  Representatives and Senate.  In the event the commission 
  2-43  makes a report of its findings and recommendations, with 
  2-44  suggestions for proposed legislation, if any, such report

  3- 1  shall be made on or before December 1, 1999.  The commission
