SENATE BILL 408

A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Article 1 of Chapter 7 of Title 46 of the Official
1- 2 Code of Georgia Annotated, relating to motor common
1- 3 carriers, so as to allow filing a certificate of insurance
1- 4 in lieu of a bond for the protection of the public and of
1- 5 passengers and baggage or for the owner or person entitled
1- 6 to recover for loss of or damage to freight; to provide for
1- 7 filing by the insurer and the effect of failure to file any
1- 8 form required by the commission; to repeal conflicting laws;
1- 9 and for other purposes.
1-10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-11 SECTION 1.
1-12 Article 1 of Chapter 7 of Title 46 of the Official Code of
1-13 Georgia Annotated, relating to motor common carriers, is
1-14 amended in Code Section 46-7-12, relating to the requirement
1-15 as to obtaining a security bond, indemnity insurance, or
1-16 self-insurance, by striking subsection (c) in its entirety,
1-17 and inserting in its place the following:
1-18 "(c) The commission may, in its discretion, allow the
1-19 holder of such filing of a certificate or permit to file
1-20 of insurance on forms prescribed by the commissioner, in
1-21 lieu of such bond, evidencing a policy of indemnity
1-22 insurance in some indemnity insurance company authorized
1-23 to do business in this state, which policy must
1-24 substantially conform to all of the provisions of this
1-25 article relating to bonds. Such policy must also be
1-26 approved by the commission certificate shall be filed by
1-27 the insurer. The failure to file any form required by the
1-28 commission shall not diminish the rights of any person to
1-29 pursue an action directly against a motor carrier's
1-30 insurer."
1-31 SECTION 2.
1-32 All laws and parts of laws in conflict with this Act are
1-33 repealed.
