                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 36-32-9 of the Official Code of 
  1- 2  Georgia Annotated, relating to jurisdiction of municipal 
  1- 3  courts over cases of shoplifting of $100.00 or less, so as 
  1- 4  to change the jurisdictional amount; to repeal conflicting 
  1- 5  laws; and for other purposes. 
 
  1- 6       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 7                           SECTION 1. 
 
  1- 8  Code Section 36-32-9 of the Official Code of Georgia 
  1- 9  Annotated, relating to jurisdiction of municipal courts over 
  1-10  cases of shoplifting of $100.00 or less, is amended by 
  1-11  striking subsections (a) through (c) and inserting in lieu 
  1-12  thereof the following: 
 
  1-13    "(a) The municipal court is granted jurisdiction to try 
  1-14    and dispose of cases in which a person is charged with a 
  1-15    first, second, or third offense of theft by shoplifting 
  1-16    when the property which was the subject of the theft was 
  1-17    valued at $100.00 $300.00 or less, if the offense occurred 
  1-18    within the corporate limits of the municipality.  The 
  1-19    jurisdiction of such court shall be concurrent with the 
  1-20    jurisdiction of any other courts within the county having 
  1-21    jurisdiction to try and dispose of such cases. 
 
  1-22    (b) Any defendant charged in a municipal court with a 
  1-23    first, second, or third offense of theft by shoplifting 
  1-24    property valued at $100.00 $300.00 or less shall be 
  1-25    entitled upon request to have the case against him or her 
  1-26    transferred to the court having general misdemeanor 
  1-27    jurisdiction in the county in which the alleged offense 
  1-28    occurred. 
 
  1-29    (c) A person convicted in a municipal court of a first, 
  1-30    second, or third offense of theft by shoplifting property 
  1-31    valued at $100.00 $300.00 or less shall be punished as 
  1-32    provided in paragraph (1) of subsection (b) of Code 
  1-33    Section 16-8-14, provided that nothing in this Code 
  1-34    section or Code Section 16-8-14 shall be construed to give

  2- 1    any municipality the right to impose a fine or punishment 
  2- 2    by imprisonment in excess of the limits as set forth in 
  2- 3    the municipality's charter." 
 
  2- 4                           SECTION 2. 
 
  2- 5  All laws and parts of laws in conflict with this Act are
