The Senate Ethics Committee offers the following
substitute to SR 416:
A RESOLUTION
1- 1 To create the Fulton-DeKalb Hospital Authority Overview
1- 2 Committee; and for other purposes.
1- 3 WHEREAS, the provision of public health services is a vital
1- 4 concern to the citizens of this state, including the
1- 5 citizens of Fulton County and DeKalb County; and
1- 6 WHEREAS, the Fulton-DeKalb Hospital Authority was created to
1- 7 promote the public health goals and to meet the public
1- 8 health needs of those two counties; and
1- 9 WHEREAS, the Fulton-DeKalb Hospital Authority is a creature
1-10 of the General Assembly, having been authorized by general
1-11 law for the purpose of providing a mechanism for the
1-12 operation and maintenance of needed health care facilities
1-13 in Fulton County and DeKalb County; and
1-14 WHEREAS, the General Assembly finds, as a result of interim
1-15 study and evaluation, that it is incumbent upon the members
1-16 of this body to periodically review the efficiency and
1-17 effectiveness with which the Fulton-DeKalb Hospital
1-18 Authority is meeting its legislatively created purposes.
1-19 NOW, THEREFORE, BE IT RESOLVED BY THE GENERAL ASSEMBLY OF
1-20 GEORGIA:
1-21 SECTION 1.
1-22 There is created the Fulton-DeKalb Hospital Authority
1-23 Overview Committee to be composed of the following nine
1-24 members: three members of the House of Representatives
1-25 appointed by the Speaker of the House, at least one of whom
1-26 shall be from the area served by the authority; three
1-27 members of the Senate, to be appointed by the President
1-28 thereof, at least one of whom shall be from the area served
1-29 by the authority; and three members of the General Assembly
1-30 appointed by the Governor, at least one of whom shall be
1-31 from the area served by the authority. The appointed
1-32 members of the committee shall serve two-year terms
1-33 concurrent with their terms as members of the General
1-34 Assembly. The chairperson of the committee shall be
1-35 appointed by the President of the Senate from the membership
1-36 of the committee, and the vice chairperson of the committee

2- 1 shall be appointed by the Speaker of the House from the
2- 2 membership of the committee. The chairperson and vice
2- 3 chairperson shall serve terms of two years concurrent with
2- 4 their terms as members of the General Assembly. Vacancies
2- 5 in an appointed member's position or in the offices of
2- 6 chairperson or vice chairperson of the committee shall be
2- 7 filled for the unexpired term in the same manner as the
2- 8 original appointment. The committee shall periodically
2- 9 inquire into and review the operations, budget contracts,
2-10 safety, financing, organization, and structure of the
2-11 Fulton-DeKalb Hospital Authority, as well as periodically
2-12 review and evaluate the success with which said authority is
2-13 accomplishing its legislatively created purposes.
2-14 SECTION 2.
2-15 The state auditor and the Attorney General shall make
2-16 available to the committee the services of their staffs'
2-17 facilities in order to assist the committee in its discharge
2-18 of its duties herein set forth. Upon authorization by joint
2-19 resolution of the General Assembly, the committee shall have
2-20 the power while the General Assembly is in session or during
2-21 the interim between sessions to request the attendance of
2-22 witnesses and the production of documents in aid of its
2-23 duties.
2-24 SECTION 3.
2-25 The Fulton-DeKalb Hospital Authority shall cooperate with
2-26 the committee, its authorized personnel, the Attorney
2-27 General, and the state auditor in order that the charges of
2-28 the committee, set forth in this resolution, may be timely
2-29 and efficiently discharged. The authority shall submit to
2-30 the committee such reports and data as the committee shall
2-31 reasonably require of the authority in order that the
2-32 committee may adequately inform itself of the activities of
2-33 the authority required by this resolution. The Attorney
2-34 General is authorized to bring appropriate legal actions to
2-35 enforce any laws specifically or generally relating to the
2-36 authority. The committee shall, on or before the first day
2-37 of January of each year, and at such other times as it deems
2-38 to be in the public interest, submit to the General Assembly
2-39 a report of its findings and recommendations based upon the
2-40 review of the operations of the Fulton-DeKalb Hospital
2-41 Authority, as set forth in this resolution.

3- 1 SECTION 4.
3- 2 In the discharge of its duties, the committee shall evaluate
3- 3 the performance of the authority in providing public health
3- 4 care services consistent with the following criteria:
3- 5 (1) Delivery of services;
3- 6 (2) Prudent, legal, and accountable expenditure of
3- 7 public funds;
3- 8 (3) Responsiveness to community needs and community
3- 9 desires; and
3-10 (4) Efficient operation.
3-11 SECTION 5.
3-12 (a) The committee is authorized to expend state funds
3-13 available to the committee for the discharge of its duties.
3-14 (b) The members of the committee shall receive the same
3-15 compensation, per diem, expenses, and allowances for their
3-16 service on the committee as is authorized by law for members
3-17 of interim legislative study committees.
3-18 (c) The funds necessary for the purposes of this resolution
3-19 shall come from the funds appropriated to and available to
3-20 the legislative branch of government.
