                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Chapter 45 of Title 43 of the Official Code of 
  1- 2  Georgia Annotated, known as the "Structural Pest Control 
  1- 3  Act," so as to provide requirements relative to official 
  1- 4  Georgia wood infestation inspection reports and guarantees 
  1- 5  related thereto; to provide for rules and regulations; to 
  1- 6  provide for applicability; to repeal conflicting laws; and 
  1- 7  for other purposes. 
 
  1- 8       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 9                           SECTION 1. 
 
  1-10  Chapter 45 of Title 43 of the Official Code of Georgia 
  1-11  Annotated, known as the "Structural Pest Control Act," is 
  1-12  amended by adding a new Code Section 43-45-16.1 to read as 
  1-13  follows: 
 
  1-14    "43-45-16.1. 
 
  1-15    The commission and the Commissioner shall provide by rule 
  1-16    or regulation for the issuance of official Georgia wood 
  1-17    infestation inspection reports.  Such reports shall be 
  1-18    written instruments issued for the purpose of certifying 
  1-19    that a structure is apparently free from wood-destroying 
  1-20    organisms as a basis for transfer of real property and 
  1-21    shall be issued only by a pest control operator certified 
  1-22    in wood-destroying organisms.  Such instrument shall carry 
  1-23    a guarantee that if an infestation of wood-destroying 
  1-24    organisms from which apparent freedom is certified is 
  1-25    found within one year from the date of issuance, the 
  1-26    infested structure shall be treated by the licensee free 
  1-27    of charge and subject to such reasonable terms and 
  1-28    conditions as specified in such rules or regulations. 
  1-29    This Code section shall apply to all official Georgia wood 
  1-30    infestation inspection reports issued on or after the 
  1-31    effective date of this Code section."

  2- 2  All laws and parts of laws in conflict with this Act are
