                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Part 1 of Article 4 of Chapter 12 of Title 45 of 
  1- 2  the Official Code of Georgia Annotated, relating to 
  1- 3  management of budgetary and financial affairs, so as to 
  1- 4  provide for a criminal penalty with respect to the 
  1- 5  authorization of payments in violation of the provisions of 
  1- 6  Part 1; to repeal conflicting laws; and for other purposes. 
 
  1- 7       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 8                           SECTION 1. 
 
  1- 9  Part 1 of Article 4 of Chapter 12 of Title 45 of the 
  1-10  Official Code of Georgia Annotated, relating to management 
  1-11  of budgetary and financial affairs, is amended by striking 
  1-12  Code Section 45-12-87, relating to payments and obligations 
  1-13  regarding state appropriations, and inserting in its place a 
  1-14  new Code Section 45-12-87 to read as follows: 
 
  1-15    "45-12-87. 
 
  1-16    No payment shall be made and no obligation shall be 
  1-17    incurred against any appropriation unless such payment or 
  1-18    obligation has been authorized as provided in this part. 
  1-19    Every official authorizing payments in violation of this 
  1-20    part, or taking part therein, and every person receiving 
  1-21    such payment, or any part thereof, shall be jointly and 
  1-22    severally liable to the state for the full amount so paid 
  1-23    or received.  Every official authorizing payments in 
  1-24    violation of this part shall be guilty of a misdemeanor of 
  1-25    a high and aggravated nature." 
 
  1-26                           SECTION 2. 
 
  1-27  All laws and parts of laws in conflict with this Act are 
  1-28  repealed.
