A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 40-5-35 of the Official Code of
1- 2 Georgia Annotated, relating to reports by physicians and
1- 3 vision specialists and procedures when persons are found
1- 4 unqualified to be licensed to operate motor vehicles, so as
1- 5 to change certain provisions relating to regulations of the
1- 6 Board of Public Safety governing disqualifications for
1- 7 certain disorders and disabilities; to repeal conflicting
1- 8 laws; and for other purposes.
1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-10 SECTION 1.
1-11 Code Section 40-5-35 of the Official Code of Georgia
1-12 Annotated, relating to reports by physicians and vision
1-13 specialists and procedures when persons are found
1-14 unqualified to be licensed to operate motor vehicles, is
1-15 amended by striking subsection (a) and inserting in lieu
1-16 thereof the following:
1-17 "(a) The Driver License Advisory Board appointed by the
1-18 department shall define disorders characterized by lapses
1-19 of consciousness or other mental or physical disabilities
1-20 affecting the ability of a person to drive safely for the
1-21 purpose of the reports required by this Code section, and
1-22 the Board of Public Safety may use these definitions to
1-23 promulgate regulations making such disorders and
1-24 disabilities disqualifications, under certain conditions,
1-25 for obtaining or keeping a driver's license for any class
1-26 or classes of vehicles; provided, however, that a person
1-27 shall not be disqualified from obtaining a noncommercial
1-28 Class C driver's license for having had an episode of
1-29 lapsed or altered consciousness due to epilepsy unless
1-30 such an episode occurred within the immediately preceding
1-31 six-month period."
1-32 SECTION 2.
1-33 All laws and parts of laws in conflict with this Act are
1-34 repealed.
