A BILL TO BE ENTITLED
AN ACT
1- 1 To amend an Act creating the Board of Commissioners of Clay
1- 2 County, approved February 16, 1953 (Ga. L. 1953, Jan. - Feb.
1- 3 Sess., p. 2326), as amended, so as to change the provisions
1- 4 relating to the chairperson and vice chairperson of the
1- 5 board of commissioners and their selection and terms; to
1- 6 change the provisions relating to the compensation of the
1- 7 chairperson and members of the board of commissioners; to
1- 8 provide an effective date; to repeal conflicting laws; and
1- 9 for other purposes.
1-10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-11 SECTION 1.
1-12 An Act creating the Board of Commissioners of Clay County,
1-13 approved February 16, 1953 (Ga. L. 1953, Jan. - Feb. Sess.,
1-14 p. 2326), as amended, is amended by striking Section 8 of
1-15 said Act and inserting in its place the following:
1-16 At the first meeting of the board of commissioners in
1-17 January of each year, the board shall select one of the
1-18 members of the board as chairperson. The chairperson so
1-19 selected shall hold such office until the first meeting in
1-20 January of the following year. The chairperson shall have
1-21 such powers and duties as provided in this Act and by
1-22 ordinance or resolution of the board. At the first
1-23 meeting in January of each year, the board shall also
1-24 select a vice chairperson, who shall serve as chairperson
1-25 when the chairperson is absent."
1-26 SECTION 2.
1-27 Said Act is further amended by striking Section 9 of said
1-28 Act and inserting in its place the following:
1-29 (a) As used in this section, the term 'base salary of the
1-30 clerk of the Superior Court of Clay County' means the

2- 1 minimum annual compensation now or hereafter payable to
2- 2 the clerk of the Superior Court of Clay County as
2- 3 specified in subsection (a) of Code Section 15-6-88 of the
2- 4 Official Code of Georgia Annotated as increased for
2- 5 cost-of-living increases awarded pursuant to subsection
2- 6 (b) of said Code section, but excluding any longevity
2- 7 increases, fees, or compensation for other services
2- 8 performed by the clerk.
2- 9 (b) The chairperson of the board of commissioners shall
2-10 receive as compensation a salary equal to 21 percent of
2-11 the base salary of the clerk of the Superior Court of Clay
2-12 County. Each of the other members of the board of
2-13 commissioners shall receive as compensation a salary equal
2-14 to 8 percent of the base salary of the clerk of the
2-15 Superior Court of Clay County."
2-16 SECTION 3.
2-17 This Act shall become effective on January 1, 2001.
2-18 SECTION 4.
2-19 All laws and parts of laws in conflict with this Act are
2-20 repealed.
