                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 35-8-3 of the Official Code of Georgia 
  1- 2  Annotated, relating to the establishment of the Georgia 
  1- 3  Peace Officer Standards and Training Council, so as to 
  1- 4  provide for additional members of the council; to provide an 
  1- 5  effective date; to repeal conflicting laws; and for other 
  1- 6  purposes. 
 
  1- 7       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 8                           SECTION 1. 
 
  1- 9  Code Section 35-8-3 of the Official Code of Georgia 
  1-10  Annotated, relating to the establishment of the Georgia 
  1-11  Peace Officer Standards and Training Council, is amended by 
  1-12  striking subsections (a) and (b) and inserting in their 
  1-13  place new subsections (a) and (b) to read as follows: 
 
  1-14    "(a) The Georgia Peace Officer Standards and Training 
  1-15    Council is established. The council shall consist of 19 21 
  1-16    voting members and five advisory members. 
 
  1-17    (b) The voting members shall consist of: 
 
  1-18      (1) An appointee of the Governor who is not the Attorney 
  1-19      General, the commissioner of public safety or his or her 
  1-20      designee, the director of investigation of the Georgia 
  1-21      Bureau of Investigation or his or her designee, the 
  1-22      president of the Georgia Association of Chiefs of Police 
  1-23      or his or her designee, the president of the Georgia 
  1-24      Sheriffs Association or his or her designee, the 
  1-25      president of the Georgia Municipal Association or his or 
  1-26      her designee, the president of the Association County 
  1-27      Commissioners of Georgia or his or her designee, the 
  1-28      president of the Peace Officers' Association of Georgia 
  1-29      or his or her designee, the commissioner of corrections 
  1-30      or his or her designee, the president of the Association 
  1-31      of Public Safety Communications Officials of Georgia or 
  1-32      his or her designee, the chairperson of the State Board 
  1-33      of Pardons and Paroles or his or her designee, and the 
  1-34      president of the Georgia Prison Wardens Association or

  2- 1      his or her designee, who shall be ex officio members of 
  2- 2      the council; 
 
  2- 3      (2) Six Seven members who shall be appointed by the 
  2- 4      Governor for terms of four years, their initial 
  2- 5      appointments, however, being two three for four-year 
  2- 6      terms, two for three-year terms, and two for two-year 
  2- 7      terms.  Appointments shall be made so that there are 
  2- 8      always on the council the following persons who are 
  2- 9      appointed by the Governor: one chief of police; two 
  2-10      municipal police officers other than a chief of police; 
  2-11      one county sheriff; one city manager or mayor; one 
  2-12      director of a public safety communications agency; and 
  2-13      one county commissioner.  No person shall serve beyond 
  2-14      the time he or she holds the office or employment by 
  2-15      reason of which he or she was initially eligible for 
  2-16      appointment.  Vacancies shall be filled in the same 
  2-17      manner as the original appointment and successors shall 
  2-18      serve for the unexpired term.  Any member may be 
  2-19      appointed for additional terms; and 
 
  2-20      (3) Two members who are peace officers and who shall be 
  2-21      appointed by the Governor for terms of four years. 
  2-22      Neither person shall serve beyond the time he or she is 
  2-23      actively employed or serves as a peace officer. 
  2-24      Vacancies shall be filled in the same manner as the 
  2-25      original appointment and successors shall serve for the 
  2-26      unexpired term." 
 
  2-27                           SECTION 2. 
 
  2-28  This Act shall become effective upon its approval by the 
  2-29  Governor or upon its becoming law without such approval. 
 
  2-30                           SECTION 3. 
 
  2-31  All laws and parts of laws in conflict with this Act are
