A BILL TO BE ENTITLED
AN ACT
1- 1 To provide for an additional judge of the superior court of
1- 2 the Cobb Judicial Circuit; to provide for the initial
1- 3 appointment and subsequent election of such judge and of
1- 4 such judge's successors; to provide for terms; to prescribe
1- 5 the powers of said judge; to prescribe the compensation and
1- 6 allowances of said judge; to amend Code Section 15-6-2 of
1- 7 the Official Code of Georgia Annotated, relating to the
1- 8 number of superior court judges for each of the judicial
1- 9 circuits, so as to provide for an additional judge of the
1-10 superior court of the Cobb Judicial Circuit; to provide for
1-11 effective dates; to repeal conflicting laws; and for other
1-12 purposes.
1-13 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-14 SECTION 1.
1-15 Code Section 15-6-2 of the Official Code of Georgia
1-16 Annotated, relating to the number of superior court judges
1-17 for each of the judicial circuits, is amended by striking
1-18 paragraph (11) of said Code section in its entirety and
1-19 inserting in lieu thereof a new paragraph (11) to read as
1-20 follows:
1-21 "(11) Cobb Circuit................................ 8 9".
1-22 SECTION 2.
1-23 A new judge of the superior court is added to the Cobb
1-24 Judicial Circuit, thereby increasing to nine the number of
1-25 judges of said circuit.
1-26 SECTION 3.
1-27 The initial judge appointed as provided by this Act shall be
1-28 appointed by the Governor for a term beginning July 1, 2000,
1-29 and expiring December 31, 2002, and until a successor is
1-30 elected and qualified. A successor to the initial judge
1-31 shall be elected in a manner provided by law for the
1-32 election of judges of the superior courts of this state at
1-33 the general election in November, 2002, for a term of four

2- 1 years beginning on January 1, 2003, and until the election
2- 2 and qualification of a successor. Future successors shall
2- 3 be elected at the general election each four years
2- 4 thereafter for terms of four years and until the election
2- 5 and qualification of a successor. They shall take office on
2- 6 the first day of January following the date of the election.
2- 7 Such elections shall be held and conducted in a manner
2- 8 provided by law for the election of judges of the superior
2- 9 courts of this state.
2-10 SECTION 4.
2-11 Said additional judge shall have and may exercise all
2-12 powers, duties, dignity, jurisdiction, privileges, and
2-13 immunities of the present judges of the superior courts of
2-14 this state. Any of the judges of the superior court of said
2-15 circuit may preside over any case therein and perform any
2-16 official act as judge thereof.
2-17 SECTION 5.
2-18 The compensation, salary, and contingent expense allowance
2-19 of said additional judge shall be the same as that of the
2-20 other judges of the superior court of the Cobb Judicial
2-21 Circuit. Any salary supplements paid by the county of said
2-22 circuit shall also be applicable to the additional judge
2-23 provided for in this Act.
2-24 SECTION 6.
2-25 (a) Notwithstanding the provisions of Code Section 1-3-4.1,
2-26 the provisions of this Act relating to appointment of the
2-27 additional judge shall become effective upon the signature
2-28 of the Governor or upon becoming law without such signature.
2-29 (b) Notwithstanding the provisions of Code Section 1-3-4.1,
2-30 all other provisions of this Act shall become effective July
2-31 1, 2000.
2-32 SECTION 7.
2-33 All laws and parts of laws in conflict with this Act are
2-34 repealed.
