A BILL to amend Code Section 3-3-20 of the Official Code of
Georgia Annotated, relating to the sale of alcoholic beverages on
Sundays, election days, and Christmas Day, so as to provide that
in any county or municipality in which the sale of alcoholic
beverages is authorized, the sale of alcoholic beverages in
compliance with such authorization shall be authorized and legal
on any election day; to provide exceptions; to provide that the
local governing authority of any county in which the sale of
alcoholic beverages is authorized and the local governing
authority of any municipality in which the sale of alcoholic
beverages is authorized may, by ordinance, prohibit the sale of
alcoholic beverages on any election days; and for other purposes.

A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 3-3-20 of the Official Code of Georgia
1- 2 Annotated, relating to the sale of alcoholic beverages on
1- 3 Sundays, election days, and Christmas Day, so as to provide
1- 4 that in any county or municipality in which the sale of
1- 5 alcoholic beverages is authorized, the sale of alcoholic
1- 6 beverages in compliance with such authorization shall be
1- 7 authorized and legal on any election day; to provide
1- 8 exceptions; to provide that the local governing authority of
1- 9 any county in which the sale of alcoholic beverages is
1-10 authorized and the local governing authority of any
1-11 municipality in which the sale of alcoholic beverages is
1-12 authorized may, by ordinance, prohibit the sale of alcoholic
1-13 beverages on any election days; to repeal conflicting laws;
1-14 and for other purposes.
1-15 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-16 SECTION 1.
1-17 Code Section 3-3-20 of the Official Code of Georgia
1-18 Annotated, relating to the sale of alcoholic beverages on
1-19 Sundays, election days, and Christmas Day, is amended by
1-20 striking in its entirety paragraph (2) of subsection (b) and
1-21 inserting in lieu thereof a new
1-22 "(2)(A) Except as provided in subparagraph (B) of this
1-23 paragraph no person knowingly and intentionally shall
1-24 sell or offer to sell and paragraph (3) of this
1-25 subsection, in any county or municipality in which the
1-26 sale of alcoholic beverages is authorized, the sale of
1-27 alcoholic beverages in compliance with such
1-28 authorization shall be authorized and legal on any
1-29 election day. The prohibition of this subsection shall
1-30 apply only within the territorial boundaries for which
1-31 the election is held but such territorial boundaries
1-32 shall not include any property owned or operated by a
1-33 county, municipality, or other political subdivision
1-34 of this state for airport purposes if no person
1-35 resides on such publicly owned or operated property.

2- 1 (B) The local governing authority of any county in
2- 2 which the sale of alcoholic beverages is authorized
2- 3 and the local governing authority of any municipality
2- 4 in which the sale of alcoholic beverages is authorized
2- 5 may, by ordinance, resolution, or referendum,
2- 6 authorize prohibit the sale of alcoholic beverages on
2- 7 any election days. In any case where the governing
2- 8 authority of a county or municipality has passed an
2- 9 ordinance prohibiting the sale of alcoholic beverages
2-10 on any election days as authorized by this
2-11 subparagraph, such prohibition shall apply only within
2-12 the territorial boundaries for which the election is
2-13 held but such territorial boundaries shall not include
2-14 any property owned or operated by a county,
2-15 municipality, or other political subdivision of this
2-16 state for airport purposes if no person resides on
2-17 such publicly owned or operated property."
2-18 SECTION 2.
2-19 All laws and parts of laws in conflict with this Act are
2-20 repealed.
