                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 45-18-9 of the Official Code of 
  1- 2  Georgia Annotated, relating to right of continuation of 
  1- 3  health insurance coverage for spouse or dependents of 
  1- 4  deceased employees under the State Employees' Health 
  1- 5  Insurance Plan, so as to provide that at the time of death 
  1- 6  of any trooper of the Uniform Division of the Department of 
  1- 7  Public Safety or agent of the Georgia Bureau of 
  1- 8  Investigation who is killed in the line of duty or receives 
  1- 9  bodily injury in the line of duty which results in death 
  1-10  within 12 months thereafter and who was the beneficiary of a 
  1-11  certain contract or contracts for health insurance but whose 
  1-12  spouse or dependent child or children were not included in 
  1-13  the coverage of such contract or contracts, any spouse or 
  1-14  dependent child or children of such a trooper or agent may 
  1-15  be included in the coverage of such contract or contracts 
  1-16  for health insurance under certain conditions; to provide 
  1-17  that the State Personnel Board may promulgate and adopt 
  1-18  rules and regulations to carry out the provisions of this 
  1-19  Act; to define a certain term; to provide that the 
  1-20  provisions of this Act shall apply to the spouse or 
  1-21  dependent child or children of certain troopers of the 
  1-22  Uniform Division of the Department of Public Safety or 
  1-23  agents of the Georgia Bureau of Investigation who were 
  1-24  killed in the line of duty or received bodily injury in the 
  1-25  line of duty which resulted in death during the period from 
  1-26  July 1, 1997, to and including June 30, 2000; to repeal 
  1-27  conflicting laws; and for other purposes. 
 
  1-28       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-29                           SECTION 1. 
 
  1-30  Code Section 45-18-9 of the Official Code of Georgia 
  1-31  Annotated, relating to right of continuation of health 
  1-32  insurance coverage for spouse or dependents of deceased 
  1-33  employees under the State Employees' Health Insurance Plan, 
  1-34  is amended by adding following subsection (d) new 
  1-35  subsections (e) and (f) to read as follows:

  2- 1    "(e) At the time of death of any trooper of the Uniform 
  2- 2    Division of the Department of Public Safety or agent of 
  2- 3    the Georgia Bureau of Investigation who is killed in the 
  2- 4    line of duty or receives bodily injury in the line of duty 
  2- 5    which results in death within 12 months thereafter and who 
  2- 6    was the beneficiary of said contract or contracts for 
  2- 7    health insurance but whose spouse or dependent child or 
  2- 8    children were not included in the coverage of the contract 
  2- 9    or contracts, any spouse or dependent child or children of 
  2-10    such a trooper or agent may be included in the coverage of 
  2-11    the contract or contracts for health insurance as provided 
  2-12    in this article upon agreeing to pay contributions to the 
  2-13    cost of such coverage as may be provided by rules and 
  2-14    regulations of the board. The board may promulgate and 
  2-15    adopt rules and regulations governing the initial, 
  2-16    continuance, and discontinuance of coverage by any such 
  2-17    spouse or dependent child or children. For the purposes of 
  2-18    this subsection, the term 'in the line of duty' has the 
  2-19    same meaning as provided in paragraph (5) of Code Section 
  2-20    45-9-81. 
 
  2-21    (f) At the time of death of any trooper of the Uniform 
  2-22    Division of the Department of Public Safety or agent of 
  2-23    the Georgia Bureau of Investigation who was killed in the 
  2-24    line of duty or received bodily injury in the line of duty 
  2-25    which resulted in death during the period from July 1, 
  2-26    1997, to and including June 30, 2000, and who was the 
  2-27    beneficiary of said contract or contracts for health 
  2-28    insurance but whose spouse or dependent child or children 
  2-29    were not included in the coverage of the contract or 
  2-30    contracts, any spouse or dependent child or children of 
  2-31    such a trooper or agent may be included in the coverage of 
  2-32    the contract or contracts for health insurance as provided 
  2-33    in this article upon agreeing to pay contributions to the 
  2-34    cost of such coverage as may be provided by rules and 
  2-35    regulations of the board. The board may promulgate and 
  2-36    adopt rules and regulations governing the initial, 
  2-37    continuance, and discontinuance of coverage by any such 
  2-38    spouse or dependent child or children; provided, however, 
  2-39    that to be included in the coverage of the contract or 
  2-40    contracts for health insurance as provided in this 
  2-41    article, a spouse or dependent child or children eligible 
  2-42    under this subsection shall be required to make 
  2-43    application for such health insurance coverage prior to 
  2-44    April 1, 2001. For the purposes of this subsection, the

  3- 1    term 'in the line of duty' has the same meaning as 
  3- 2    provided in paragraph (5) of Code Section 45-9-81." 
 
  3- 3                           SECTION 2. 
 
  3- 4  All laws and parts of laws in conflict with this Act are
