A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Chapter 2 of Title 27 of the Official Code of
1- 2 Georgia Annotated, relating to licenses, permits, and stamps
1- 3 generally, so as to provide that the Department of Natural
1- 4 Resources may issue permits to trap, transport and release,
1- 5 or kill wildlife and feral hogs under certain circumstances
1- 6 where such action is otherwise prohibited by law; to provide
1- 7 that the department shall specify such conditions upon such
1- 8 permits as the department deems necessary; to provide an
1- 9 exception; to provide an effective date; to repeal
1-10 conflicting laws; and for other purposes.
1-11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-12 SECTION 1.
1-13 Chapter 2 of Title 27 of the Official Code of Georgia
1-14 Annotated, relating to licenses, permits, and stamps
1-15 generally, is amended by inserting at the end thereof the
1-16 following:
1-17 "27-2-31.
1-18 (a) The department is authorized to issue wildlife control
1-19 permits authorizing the permittee to trap, transport and
1-20 release, or kill wildlife and feral hogs where such action
1-21 is otherwise prohibited by law or regulation:
1-22 (1) When the department determines that there is a
1-23 substantial likelihood the presence of such wildlife or
1-24 feral hogs will endanger or cause injury to persons or
1-25 will destroy or damage agricultural crops, domestic
1-26 animals, buildings, structures, or other personal
1-27 property;
1-28 (2) For the control of white-tailed deer on airport
1-29 property; provided, however, that permits shall be
1-30 issued under this paragraph for purposes of public
1-31 safety, and the control of white-tailed deer for other
1-32 purposes and the removal of black bear shall be as

2- 1 provided in Code Sections 27-2-18 and 27-3-21,
2- 2 respectively;
2- 3 (3) For fur-bearing animals, as defined in paragraph
2- 4 (31) of Code Section 27-1-2, to implement a bona fide
2- 5 wildlife management plan that has been approved by the
2- 6 department; and
2- 7 (4) For feral hogs, provided that all permitted
2- 8 activities must comply with all rules and regulations of
2- 9 the Georgia Department of Agriculture.
2-10 (b) In issuing a wildlife control permit, the department
2-11 shall prescribe the method, means, species, numbers, time
2-12 limits, location, and any other conditions it deems
2-13 necessary to ensure the continued viability of the
2-14 wildlife population involved and to ensure that the public
2-15 safety and interest are not compromised.
2-16 (c) Nothing in the Code section shall be construed to
2-17 authorize the taking of any species which is protected by
2-18 the federal Endangered Species Act of 1973, Public Law
2-19 93-205, as amended, or under any state law or regulation
2-20 which has as its purpose the protection of endangered or
2-21 threatened species."
2-22 SECTION 2.
2-23 This Act shall become effective upon its approval by the
2-24 Governor or upon its becoming law without such approval.
2-25 SECTION 3.
2-26 All laws and parts of laws in conflict with this Act are
2-27 repealed.
