A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Article 2 of Chapter 34 of Title 43 of the Official
1- 2 Code of Georgia Annotated, relating to physicians, so as to
1- 3 provide for licensing retired physicians; to provide for a
1- 4 short title; to provide for conditions and limitations; to
1- 5 provide for liability and immunity from liability; to
1- 6 provide for statutory construction; to provide for automatic
1- 7 repeal and expiration of licenses; to repeal conflicting
1- 8 laws; and for other purposes.
1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-10 SECTION 1.
1-11 Article 2 of Chapter 34 of Title 43 of the Official Code of
1-12 Georgia Annotated, relating to physicians, is amended by
1-13 adding after Code Section 43-34-45 a new Code section to
1-14 read as follows:
1-15 "43-34-45.1.
1-16 (a) This Code section shall be known and may be cited as
1-17 the 'Georgia Volunteers in Medicine Health Care Act.'
1-18 (b) Notwithstanding any other provision of law, the board
1-19 may issue a special license to qualifying physicians under
1-20 the terms and conditions set forth in this Code section.
1-21 The special license may only be issued to a person who:
1-22 (1) Is currently licensed to practice medicine in any
1-23 medical-licensing jurisdiction in the United States and
1-24 whose license is in good standing; or
1-25 (2) Is retired from the practice of medicine and not
1-26 currently engaged in such practice either full time or
1-27 part time and has, prior to retirement, maintained full
1-28 licensure in good standing in any medical-licensing
1-29 jurisdiction in the United States.
1-30 (c) The special licensee shall be permitted to practice
1-31 medicine only in the noncompensated employ of public
1-32 agencies or institutions or not-for-profit agencies,

2- 1 not-for-profit institutions, nonprofit corporations, or
2- 2 not-for-profit associations which provide medical services
2- 3 only to indigent patients in medically underserved or
2- 4 critical-need population areas of the state, as determined
2- 5 by the board.
2- 6 (d) The person applying for the special license under this
2- 7 Code section shall submit to the board a copy of his or
2- 8 her medical degree, a copy of his or her license in his or
2- 9 her current or previous licensing and regulating
2-10 jurisdiction, and a notarized statement from the employing
2-11 agency, institution, corporation, or association, on a
2-12 form prescribed by the board, whereby he or she agrees
2-13 unequivocally not to receive compensation for any medical
2-14 services he or she may render while in possession of the
2-15 special license.
2-16 (e) The examination by the board, any application fees,
2-17 and all licensure and renewal fees must be waived for the
2-18 holder of the special license under this Code section and
2-19 do not apply to such person.
2-20 (f) If at the time application is made for the special
2-21 license the physician is not in compliance with the
2-22 continuing medical education requirements established by
2-23 the board, the physician shall be issued a nonrenewable
2-24 temporary license to practice for six months provided the
2-25 applicant is otherwise qualified for such license.
2-26 (g) The liability of persons practicing medicine under and
2-27 in compliance with a special license issued under this
2-28 Code section and the liability of their employers for such
2-29 practice shall be governed by Code Section 51-1-29.1.
2-30 (h) Nothing contained in this Code section shall be
2-31 construed to authorize the holder of the special license
2-32 provided for in this Code section to perform surgery or
2-33 any surgical procedure.
2-34 (i) This Code section, being in derogation of the common
2-35 law, shall be strictly construed."
2-36 SECTION 2.
2-37 This Act shall be automatically repealed July 1, 2002, upon
2-38 which date any special license issued pursuant to this Act
2-39 shall also expire.

3- 2 All laws and parts of laws in conflict with this Act are
3- 3 repealed.
