                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Article 4 of Chapter 21 of Title 15 of the Official 
  1- 2  Code of Georgia Annotated, the "Peace Officer and Prosecutor 
  1- 3  Training Fund Act of 1983," so as to provide that funds 
  1- 4  remitted pursuant to such Act shall be disbursed on an 
  1- 5  annual basis to the Georgia Public Safety Training Center 
  1- 6  and the Georgia Peace Officer Standards and Training 
  1- 7  Council; to establish the percentage of such disbursement; 
  1- 8  to provide an effective date; to repeal conflicting laws; 
  1- 9  and for other purposes. 
 
  1-10       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-11                           SECTION 1. 
 
  1-12  Article 4 of Chapter 21 of Title 15 of the Official Code of 
  1-13  Georgia Annotated, the "Peace Officer and Prosecutor 
  1-14  Training Fund Act of 1983," is amended by striking in its 
  1-15  entirety Code Section 15-21-77, relating to the 
  1-16  appropriation of funds for law enforcement or prosecutorial 
  1-17  officers' training, which reads as follows: 
 
  1-18    "15-21-77. 
 
  1-19    An amount equal to all funds remitted as provided in Code 
  1-20    Section 15-21-74 in the immediately preceding year shall 
  1-21    be appropriated to fund law enforcement or prosecutorial 
  1-22    officers' training, or both, and activities incident 
  1-23    thereto, including, but not limited to, payment or 
  1-24    repayment to the state treasury for capital outlay, 
  1-25    general obligation bond debt service, administrative 
  1-26    expenses, and any other expense or fund application which 
  1-27    the General Assembly may deem appropriate.  This Code 
  1-28    section shall not preclude the appropriation of a greater 
  1-29    amount for this purpose.", 
 
  1-30  and inserting in lieu thereof a new Code Section 15-21-77 to 
  1-31  read as follows:

  2- 1    "15-21-77. 
 
  2- 2    At the beginning of each fiscal year, the state revenue 
  2- 3    commissioner shall disburse the funds remitted during the 
  2- 4    preceding fiscal year as provided by Code Section 15-21-74 
  2- 5    to the Georgia Public Safety Training Center established 
  2- 6    by Chapter 5 of Title 35 and to the Georgia Peace Officer 
  2- 7    Standards and Training Council created by Chapter 8 of 
  2- 8    Title 35.  A percentage of such funds corresponding to the 
  2- 9    percentage the number of state employed peace officers 
  2-10    bears to the total number of publicly employed peace 
  2-11    officers during the preceding year shall be allocated to 
  2-12    the Georgia Public Safety Training Center.  The remainder 
  2-13    of such funds shall be allocated to the Georgia Peace 
  2-14    Officer Standards and Training Council.  No later than 15 
  2-15    days following the close of each fiscal year, the Georgia 
  2-16    Peace Officer Standards and Training Council shall certify 
  2-17    to the state revenue commissioner the total number of 
  2-18    state employed peace officers and the total number of 
  2-19    locally employed peace officers as reflected in the 
  2-20    official state records." 
 
  2-21                           SECTION 2. 
 
  2-22  This Act shall become effective on the first day of July 
  2-23  following the approval of this Act by the Governor or its 
  2-24  becoming law without such approval. 
 
  2-25                           SECTION 3. 
 
  2-26  All laws and parts of laws in conflict with this Act are
