A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Chapter 8 of Title 48 of the Official Code of
1- 2 Georgia Annotated, relating to sales and use taxes, so as to
1- 3 provide for an exemption from sales and use tax with respect
1- 4 to the replacement, repair, or upgrading of certain
1- 5 machinery and machinery components; to provide an effective
1- 6 date; to repeal conflicting laws; and for other purposes.
1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 8 SECTION 1.
1- 9 Chapter 8 of Title 48 of the Official Code of Georgia
1-10 Annotated, relating to sales and use taxes, is amended by
1-11 striking subparagraph (A) of paragraph (34) of Code Section
1-12 48-8-3, relating to exemptions from sales and use tax, and
1-13 inserting in its place a new subparagraph (A) to read as
1-14 follows:
1-15 "(A) Machinery, including and machinery components
1-16 thereof, which is are used directly in the manufacture
1-17 of tangible personal property when the machinery is or
1-18 machinery components are bought to replace, repair, or
1-19 upgrade machinery or machinery components in a
1-20 manufacturing plant presently existing in this state.
1-21 For purposes of this subparagraph, 'machinery
1-22 components' shall include but not be limited to
1-23 replacement tooling and repair parts;".
1-24 SECTION 2.
1-25 This Act shall become effective upon its approval by the
1-26 Governor or upon its becoming law without such approval.
1-27 SECTION 3.
1-28 All laws and parts of laws in conflict with this Act are
1-29 repealed.
