                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To repeal a local amendment to Article V, Section IX of the 
  1- 2  Constitution of the State of Georgia creating the Gwinnett 
  1- 3  Industrial Building Authority; to provide for a referendum; 
  1- 4  to provide for an effective date and for automatic repeal; 
  1- 5  to repeal conflicting laws; and for other purposes. 
 
  1- 6       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 7                           SECTION 1. 
 
  1- 8  A local amendment to Article V, Section IX of the 
  1- 9  Constitution of the State of Georgia, creating the Gwinnett 
  1-10  Industrial Building Authority, ratified by the voters 
  1-11  November 6, 1962 (Ga. L. 1962, p. 927), and continued by an 
  1-12  Act approved March 25, 1986 (Ga. L. 1986, p. 4549), is 
  1-13  hereby repealed in its entirety. 
 
  1-14                           SECTION 2. 
 
  1-15  Unless prohibited by the federal Voting Rights Act of 1965, 
  1-16  as amended, the election superintendent of Gwinnett County 
  1-17  shall call and conduct an election as provided in this 
  1-18  section for the purpose of submitting this Act to the 
  1-19  electors of Gwinnett County for approval or rejection.  The 
  1-20  election superintendent shall conduct that election on the 
  1-21  date of and in conjunction with the general election in 
  1-22  November, 2000, and shall issue the call and conduct that 
  1-23  election as provided by general law.  The superintendent 
  1-24  shall cause the date and purpose of the election to be 
  1-25  published once a week for two weeks immediately preceding 
  1-26  the date thereof in the official organ of Gwinnett County. 
  1-27  The ballot shall have written or printed thereon the words: 
 
  1-28    "(  ) YES Shall the Act be approved which repeals a 
  1-29              local constitutional amendment creating the 
  1-30     (  ) NO  Gwinnett Industrial Building Authority?" 
 
  1-31  All persons desiring to vote for approval of the Act shall 
  1-32  vote "Yes," and those persons desiring to vote for rejection 
  1-33  of the Act shall vote "No."  If more than one-half of the

  2- 1  votes cast on such question are for approval of the Act, it 
  2- 2  shall become of full force and effect January 1, 2001. If 
  2- 3  the Act is not so approved or if the election is not 
  2- 4  conducted as provided in this section, the remaining 
  2- 5  sections of this Act shall not become effective and this Act 
  2- 6  shall be automatically repealed on the first day of January 
  2- 7  immediately following that election date. 
 
  2- 8  The expense of such election shall be borne by Gwinnett 
  2- 9  County.  It shall be the election superintendent's duty to 
  2-10  certify the result thereof to the Secretary of State. 
 
  2-11                           SECTION 3. 
 
  2-12  The provisions of Section 2 of this Act shall become 
  2-13  effective upon approval of this Act by the Governor or upon 
  2-14  its becoming law without such approval. The remaining 
  2-15  provisions shall become effective on January 1, 2001, if the 
  2-16  referendum provided for in Section 2 of this Act is 
  2-17  approved. 
 
  2-18                           SECTION 3. 
 
  2-19  All laws and parts of laws in conflict with this Act are
