A BILL to amend Code Section 40-13-53 of the Official Code of
Georgia Annotated, relating to release of person arrested for
traffic violation upon service of citation and complaint, so as
to provide that failure to stop for a pedestrian in a crosswalk
shall not be treated as a traffic violation pursuant to Code
Section 40-13-60 but rather as a misdemeanor in accordance with
Code Section 40-6-1; and for other purposes.

A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 40-6-91 of the Official Code of
1- 2 Georgia Annotated, relating to right of way in crosswalks
1- 3 with respect to the uniform rules of the road, so as to
1- 4 change the penalty provisions applicable to operators of
1- 5 vehicles who violate this Code section; to provide certain
1- 6 mandatory minimum fines for the offense of failing to stop
1- 7 for a pedestrian in a crosswalk; to provide that certain
1- 8 fines assessed shall not be subject to suspension, stay, or
1- 9 probation; to repeal conflicting laws; and for other
1-10 purposes.
1-11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-12 SECTION 1.
1-13 Code Section 40-6-91 of the Official Code of Georgia
1-14 Annotated, relating to right of way in crosswalks with
1-15 respect to the uniform rules of the road, is amended by
1-16 adding at the end thereof a new subsection (e) to read as
1-17 follows:
1-18 "(e)(1) Any operator of a vehicle who violates this Code
1-19 section shall be guilty of a misdemeanor. With respect
1-20 to any fines assessed for a violation of this Code
1-21 section, a violator shall be punished by a mandatory
1-22 minimum fine of:
1-23 (A) Not less than $200.00 for a first such offense;
1-24 and
1-25 (B) Not less than $500.00 for a second or subsequent
1-26 such offense occurring within a five-year period of
1-27 time.
1-28 (2) Any fine assessed under paragraph (1) of this
1-29 subsection shall not be subject to suspension, stay, or
1-30 probation."

2- 2 All laws and parts of laws in conflict with this Act are
2- 3 repealed.
