                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Article 2 of Chapter 12 of Title 45 of the Official 
  1- 2  Code of Georgia Annotated, relating to powers and duties of 
  1- 3  the Governor, so as to provide for the composition of the 
  1- 4  council which determines the capacity and cessation of the 
  1- 5  incapacity of the Commissioner of Insurance; to conform Code 
  1- 6  Section 45-12-24 to Code Section 45-12-23; to repeal 
  1- 7  conflicting laws; and for other purposes. 
 
  1- 8       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 9                           SECTION 1. 
 
  1-10  Article 2 of Chapter 12 of Title 45 of the Official Code of 
  1-11  Georgia Annotated, relating to powers and duties of the 
  1-12  Governor, is amended by striking in its entirety Code 
  1-13  Section 45-12-24, relating to proceedings upon the cessation 
  1-14  of the incapacity of the Commissioner of Insurance, and 
  1-15  inserting in its place the following: 
 
  1-16    "45-12-24. 
 
  1-17    Whenever it shall be made to appear to the council 
  1-18    composed of the Governor, the Secretary of State, and an 
  1-19    appointee of the Governor who is not the Attorney General, 
  1-20    as provided in this Code section and Code Section 45-12-23 
  1-21    or a majority thereof, that the incapacity of the 
  1-22    Commissioner of Insurance has been overcome and removed, a 
  1-23    finding in writing to that effect shall be made and filed 
  1-24    in the Governor's office; and thereupon the authority of 
  1-25    the person designated to act for the Commissioner of 
  1-26    Insurance shall come to an end and the Commissioner of 
  1-27    Insurance shall assume and perform the duties of his 
  1-28    office.  During the period of the incapacity of the 
  1-29    Commissioner of Insurance, the salaries due as provided by 
  1-30    existing law shall continue to be paid." 
 
  1-31                           SECTION 2. 
 
  1-32  All laws and parts of laws in conflict with this Act are 
  1-33  repealed
