                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 37-2-7 of the Official Code of Georgia 
  1- 2  Annotated, relating to the state plan for disability 
  1- 3  services, so as to provide for guidelines for planning lists 
  1- 4  for the provision of certain disability services, when such 
  1- 5  services are not available at the time of the request; to 
  1- 6  provide for guidelines for a registry of persons who have 
  1- 7  been diagnosed with certain disabilities but have not yet 
  1- 8  requested services; to provide an effective date; to repeal 
  1- 9  conflicting laws; and for other purposes. 
 
  1-10       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-11                           SECTION 1. 
 
  1-12  Code Section 37-2-7 of the Official Code of Georgia 
  1-13  Annotated, relating to the state plan for disability 
  1-14  services, is amended by adding a new subsection (b.1) to 
  1-15  read as follows: 
 
  1-16      "(b.1)(1) The plan shall include state-wide guidelines 
  1-17      for short-term and long-term planning lists for the 
  1-18      provision of requested disability services for persons 
  1-19      whose disability is mental retardation or another 
  1-20      neurologically disabling condition which requires 
  1-21      treatment similar to that for the mentally retarded, 
  1-22      when such services are not available at the time of such 
  1-23      request.  The guidelines shall provide for the 
  1-24      commencement of services, as soon as practicable but no 
  1-25      later than 180 days following a request, to such persons 
  1-26      who are placed on a short-term planning list.  The 
  1-27      guidelines shall also include criteria under which a 
  1-28      person named on a planning list may obtain priority to 
  1-29      receive the requested services when they become 
  1-30      available and under which such persons not named on a 
  1-31      planning list may receive requested services in 
  1-32      emergencies. 
 
  1-33      (2) The plan shall include state-wide guidelines for a 
  1-34      registry of persons who have been diagnosed with mental

  2- 1      retardation or another neurologically disabling 
  2- 2      condition which requires treatment similar to that for 
  2- 3      the mentally retarded and wish to make such diagnosis 
  2- 4      known to the division and regional boards, but who have 
  2- 5      not yet requested disability services." 
 
  2- 6                           SECTION 2. 
 
  2- 7  This Act shall become effective only when funds are 
  2- 8  specifically appropriated for the purposes of this Act in an 
  2- 9  appropriation Act making specific reference to this Act. 
 
  2-10                           SECTION 3. 
 
  2-11  All laws and parts of laws in conflict with this Act are
