                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 50-5-67 of the Official Code of 
  1- 2  Georgia Annotated, relating to competitive bidding for state 
  1- 3  purchases, so as to provide for display on the Internet of 
  1- 4  the names of successful bidders, the names of unsuccessful 
  1- 5  bidders, and the reasons for rejecting bidders; to provide 
  1- 6  that such information shall remain available on the Internet 
  1- 7  for at least 12 months; to provide for related matters; to 
  1- 8  repeal conflicting laws; and for other purposes. 
 
  1- 9       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-10                           SECTION 1. 
 
  1-11  Code Section 50-5-67 of the Official Code of Georgia 
  1-12  Annotated, relating to competitive bidding for state 
  1-13  purchases, is amended by striking in its entirety subsection 
  1-14  (d) and inserting in its place the following: 
 
  1-15    "(d) Every bid conforming to the terms of the 
  1-16    advertisement provided for in this Code section, together 
  1-17    with the name of the bidder, shall be recorded, and all 
  1-18    such records with the name of the successful bidder 
  1-19    indicated thereon shall, after award or letting of the 
  1-20    contract, be subject to public inspection upon request. 
  1-21    The Department of Administrative Services shall also, 
  1-22    within five days after the award or letting of the 
  1-23    contract, publish the name of the successful bidder on 
  1-24    public display in a conspicuous place in the department's 
  1-25    office and on a designated Internet site that is part of, 
  1-26    or linked to, the Georgia Procurement Registry described 
  1-27    in subsection (b) of Code Section 50-5-69 so that it may 
  1-28    be easily seen by the public. The public notice on public 
  1-29    display shall also show the price or the amount for which 
  1-30    the contract was let and the commodities covered by the 
  1-31    contract.  The Department of Administrative Services shall 
  1-32    also and in the same manner, within five days after the 
  1-33    award or letting of the contract, publish on public 
  1-34    display the names of all persons whose bids were rejected 
  1-35    by it, together with a statement giving the reasons for

  2- 1    such rejection.  All the information required to be placed 
  2- 2    on public display in a conspicuous place at the office of 
  2- 3    the Department of Administrative Services and on a 
  2- 4    designated Internet site that is part of, or linked to, 
  2- 5    the Georgia Procurement Registry shall also be recorded in 
  2- 6    a permanent book to be kept by the Department of 
  2- 7    Administrative Services, which record shall always be 
  2- 8    subject to public inspection upon request.  The 
  2- 9    information placed on the Internet shall remain available 
  2-10    in that medium for at least 12 months.  Bids shall be 
  2-11    opened in public by the Department of Administrative 
  2-12    Services, which shall canvass the bids and award the 
  2-13    contract according to the terms of this part. A proper 
  2-14    bond for the faithful performance of any contract shall be 
  2-15    required of the successful bidder in the discretion of the 
  2-16    Department of Administrative Services. After the contracts 
  2-17    have been awarded, the Department of Administrative 
  2-18    Services shall certify to the various departments, 
  2-19    institutions, and agencies of the state government the 
  2-20    sources of the supplies and the contract price of the 
  2-21    various supplies, materials, and equipment so contracted 
  2-22    for." 
 
  2-23                           SECTION 2. 
 
  2-24  All laws and parts of laws in conflict with this Act are
