                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Chapter 23 of Title 47 of the Official Code of 
  1- 2  Georgia Annotated, relating to the Georgia Judicial 
  1- 3  Retirement System, so as to provide that judges and 
  1- 4  solicitors-general of the State Court of Fulton County may 
  1- 5  elect membership in such retirement system; to provide for 
  1- 6  the transfer of creditable service; to provide conditions 
  1- 7  for an effective date and automatic repeal; to repeal 
  1- 8  conflicting laws; and for other purposes. 
 
  1- 9       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-10                           SECTION 1. 
 
  1-11  Chapter 23 of Title 47 of the Official Code of Georgia 
  1-12  Annotated, relating to the Georgia Judicial Retirement 
  1-13  System, is amended by striking paragraph (14) of Code 
  1-14  Section 47-23-1, relating to definitions, and inserting in 
  1-15  lieu thereof the following: 
 
  1-16      "(14) "State court" means any court created pursuant to 
  1-17      the provisions of Chapter 7 of Title 15 or any court 
  1-18      continued as a state court by Article VI, Section X of 
  1-19      the Constitution of the State of Georgia; provided, 
  1-20      however, that, except as otherwise provided in Code 
  1-21      Section 47-23-48, such term shall not include the State 
  1-22      Court of Fulton County." 
 
  1-23                           SECTION 2. 
 
  1-24  Said chapter is further amended by inserting immediately 
  1-25  following Code Section 47-23-47 a new Code section to read 
  1-26  as follows: 
 
  1-27  .A NAME="47-23-48">  "47-23-48 
 
  1-28    Any person serving as a judge or solicitor-general of the 
  1-29    State Court of Fulton County may make an irrevocable 
  1-30    election to become a member of this retirement system by 
  1-31    so notifying the board of trustees not later than December 
  1-32    31, 2000, or within 90 days after becoming so employed, 
  1-33    whichever date is later. Any such person shall be credited

  2- 1    with service in this retirement system only for actual 
  2- 2    service in such position. The employees' pension plan 
  2- 3    maintained by Fulton County shall transfer to this 
  2- 4    retirement system all employer and employee contributions 
  2- 5    paid by or on behalf of any such member with regular 
  2- 6    interest thereon. Each member shall receive such 
  2- 7    creditable service in this retirement system as he or she 
  2- 8    had been credited in the county retirement system, and 
  2- 9    such service shall be calculated for all purposes, 
  2-10    including, without limitation, spouses' survival 
  2-11    benefits." 
 
  2-12                           SECTION 3. 
 
  2-13  This Act shall become effective on July 1, 2000, only if it 
  2-14  is determined to have been concurrently funded as provided 
  2-15  in Chapter 20 of Title 47 of the Official Code of Georgia 
  2-16  Annotated, the "Public Retirement Systems Standards Law"; 
  2-17  otherwise, this Act shall not become effective and shall be 
  2-18  automatically repealed in its entirety on July 1, 2000, as 
  2-19  required by subsection (a) of Code Section 47-20-50. 
 
  2-20                           SECTION 4. 
 
  2-21  All laws and parts of laws in conflict with this Act are
