                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Chapter 10 of Title 16 of the Official Code of 
  1- 2  Georgia Annotated, relating to offenses against public 
  1- 3  administration, so as to provide that the offense of 
  1- 4  hindering the apprehension or punishment of a criminal 
  1- 5  applies to such actions in relation to a person known or 
  1- 6  reasonably believed to have committed a misdemeanor; to 
  1- 7  provide a penalty; to repeal conflicting laws; and for other 
  1- 8  purposes. 
 
  1- 9       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-10                           SECTION 1. 
 
  1-11  Chapter 10 of Title 16 of the Official Code of Georgia 
  1-12  Annotated, relating to offenses against public 
  1-13  administration, is amended by striking in its entirety Code 
  1-14  Section 16-10-50, relating to hindering the apprehension of 
  1-15  punishment of a criminal, and inserting in its place the 
  1-16  following: 
 
  1-17    "16-10-50. 
 
  1-18    (a) A person commits the offense of hindering the 
  1-19    apprehension or punishment of a criminal when, with 
  1-20    intention to hinder the apprehension or punishment of a 
  1-21    person whom he or she knows or has reasonable grounds to 
  1-22    believe has committed a felony or misdemeanor or to be an 
  1-23    escaped inmate or prisoner, he or she: 
 
  1-24      (1) Harbors or conceals such person; or 
 
  1-25      (2) Conceals or destroys evidence of the crime. 
 
  1-26      (b)(1) A person convicted of the offense of hindering 
  1-27      apprehension or punishment of a criminal shall be 
  1-28      punished by imprisonment for not less than one nor more 
  1-29      than five years if the person convicted knew or had 
  1-30      reasonable grounds to believe the person harbored or 
  1-31      concealed had committed a felony or to be an escaped 
  1-32      inmate or prisoner, or if the person convicted concealed 
  1-33      or destroyed evidence of a felony.

  2- 1      (2) A person convicted of the offense of hindering the 
  2- 2      apprehension of a criminal shall be punished by 
  2- 3      imprisonment for not more than one year if the person 
  2- 4      convicted knew or had reasonable grounds to believe the 
  2- 5      person harbored or concealed committed a misdemeanor, or 
  2- 6      if the person convicted concealed or destroyed evidence 
  2- 7      of a misdemeanor." 
 
  2- 8                           SECTION 2. 
 
  2- 9  All laws and parts of laws in conflict with this Act are
