                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend an Act creating the State Court of Ware County, 
  1- 2  formerly the City Court of Waycross, approved December 11, 
  1- 3  1897 (Ga. L. 1897, p. 510), as amended, particularly by an 
  1- 4  Act approved March 30, 1993 (Ga. L. 1993, p. 4284) and an 
  1- 5  Act approved April 7, 1997 (Ga. L. 1997, p. 3832), so as to 
  1- 6  provide for the compensation of the solicitor-general and 
  1- 7  the judge of said court; to provide for related matters; to 
  1- 8  provide an effective date; to repeal conflicting laws; and 
  1- 9  for other purposes. 
 
  1-10       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-11                           SECTION 1. 
 
  1-12  To amend an Act creating the State Court of Ware County, 
  1-13  formerly the City Court of Waycross, approved December 11, 
  1-14  1897 (Ga. L. 1897, p. 510), as amended, particularly by an 
  1-15  Act approved March 30, 1993 (Ga. L. 1993, p. 4284) and an 
  1-16  Act approved April 7, 1997 (Ga. L. 1997, p. 3832), is 
  1-17  amended by striking Section 4A which reads as follows: 
 
 
 
  1-18    Following the effective date of this Act, the 
  1-19    solicitor-general of the State Court of Ware County shall 
  1-20    receive a salary in such an amount as to provide for a 
  1-21    total salary for such solicitor-general for the calendar 
  1-22    year of 1997 and annually thereafter, in the amount of 
  1-23    $36,000.00 or such larger amount as may from time to time 
  1-24    be provided for by general state law.  The judge of the 
  1-25    State Court of Ware County shall receive an annual salary 
  1-26    of $40,000.00 or such larger amount as may from time to 
  1-27    time be provided for by general state law.  Said 
  1-28    compensation shall be paid in equal monthly installments 
  1-29    from funds of Ware County.  Ware County shall be 
  1-30    authorized but not required to supplement such salaries, 
  1-31    or either of them, in such an amount or amounts as its 
  1-32    Board of Commissioners may from time to time determine.",

  2- 1  and inserting in its place a new Section 4A to read as 
  2- 2  follows: 
 
 
 
  2- 3    (a) The solicitor-general of the State Court of Ware 
  2- 4    County shall receive an annual salary in the amount of 
  2- 5    $36,000.00 or such larger amount as may from time to time 
  2- 6    be provided for by general state law.  The judge of the 
  2- 7    State Court of Ware County shall receive an annual salary 
  2- 8    of $40,000.00 or such larger amount as may from time to 
  2- 9    time be provided for by general state law.  Said 
  2-10    compensation shall be paid in equal monthly installments 
  2-11    from funds of Ware County. 
 
  2-12    (b) The salary of the judge and of the solicitor-general 
  2-13    of the State Court of Ware County shall be increased in 
  2-14    the same percentage and at the same time as provided for 
  2-15    clerks of the superior courts in subsection (a) of Code 
  2-16    Section 15-6-90.  In addition, whenever the employees in 
  2-17    the classified service of the state merit system receive a 
  2-18    cost-of-living increase or general performance based 
  2-19    increase of a certain percentage or a certain amount, the 
  2-20    amounts fixed as the salary of such judge and such 
  2-21    solicitor-general by subsection (a) of this section or the 
  2-22    amounts derived by increasing each of said amounts through 
  2-23    the application of longevity increases pursuant to 
  2-24    subsection (a) of Code Section 15-6-90, where applicable, 
  2-25    shall be increased by the same percentage or same amount 
  2-26    applicable to such state employees.  If the cost-of-living 
  2-27    increase or general performance based increase received by 
  2-28    state employees is in different percentages or different 
  2-29    amounts as to certain categories of employees, the amounts 
  2-30    fixed as the salary fixed for such judge and such 
  2-31    solicitor-general, or the amounts derived through the 
  2-32    application of longevity increases, shall be increased by 
  2-33    a percentage or an amount not to exceed the average 
  2-34    percentage or average amount of the general increase in 
  2-35    salary granted to the state employees.  The Office of 
  2-36    Planning and Budget may be consulted in order for the 
  2-37    county to calculate the average percentage increase or 
  2-38    average amount increase when necessary.  The periodic 
  2-39    changes in the amounts fixed as the salary fixed for such 
  2-40    judge and such solicitor-general, or the amounts derived 
  2-41    through the application of longevity increases, as 
  2-42    authorized by this subsection shall become effective on 
  2-43    the first day of January following the date that the

  3- 1    cost-of-living increases or general performance based 
  3- 2    increases received by state employees become effective; 
  3- 3    provided, however, that if the cost-of-living increases 
  3- 4    received by state employees become effective on January 1, 
  3- 5    such periodic changes in the amounts fixed as the salary 
  3- 6    fixed for such judge and such solicitor-general, 
  3- 7    respectively, of such State Court, or the amounts derived 
  3- 8    by increasing each of said amounts through the application 
  3- 9    of longevity increases shall become effective on the same 
  3-10    date that the cost-of-living increases or general 
  3-11    performance based increases received by state employees 
  3-12    become effective." 
 
  3-13                           SECTION 2. 
 
  3-14  This Act shall become effective on January 1, 2000. 
 
  3-15                           SECTION 3. 
 
  3-16  All laws and parts of laws in conflict with this Act are
