                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 16-12-35 of the Official Code of 
  1- 2  Georgia Annotated, relating to the nonapplicability of Part 
  1- 3  1 of Article 2 of Chapter 12 of Title 16 of the Official 
  1- 4  Code of Georgia Annotated to certain materials, equipment, 
  1- 5  devices, and bona fide coin operated amusement machines, so 
  1- 6  as to clarify the applicability of certain criminal statutes 
  1- 7  to coin operated games or devices; to clarify rewards that 
  1- 8  such games may provide; to provide for accumulation, 
  1- 9  carry-over, and redemption of winnings; to repeal 
  1-10  conflicting laws; and for other purposes. 
 
  1-11       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-12                           SECTION 1. 
 
  1-13  Code Section 16-12-35 of the Official Code of Georgia 
  1-14  Annotated, relating to the nonapplicability of Part 1 of 
  1-15  Article 2 of Chapter 12 of Title 16 of the Official Code of 
  1-16  Georgia Annotated to certain materials, equipment, devices, 
  1-17  and bona fide coin operated amusement machines, is amended 
  1-18  by striking in its entirety subsection (d) and inserting in 
  1-19  its place the following: 
 
  1-20      "(d)(1) Nothing in this part shall apply to a coin 
  1-21      operated game or device designed and manufactured only 
  1-22      for bona fide amusement purposes which involves some 
  1-23      skill in its operation if it rewards the player 
  1-24      exclusively with: 
 
  1-25        (A) Free free replays; or merchandise 
 
  1-26        (B) Merchandise limited to noncash merchandise, 
  1-27        prizes, toys, gift certificates, or novelties, each of 
  1-28        which has a wholesale value of not more than $5.00 
  1-29        received for a single play of the game or device; 
 
  1-30        (C) Points, tokens, vouchers, tickets, or other 
  1-31        evidence of winnings which may be exchanged for 
  1-32        rewards set out in subparagraph (A) of this paragraph 
  1-33        or subparagraph (B) of this paragraph or a combination

  2- 1        of rewards set out in subparagraph (A) and 
  2- 2        subparagraph (B) of this paragraph; or 
 
  2- 3        (D) Any combination of rewards set out in two or more 
  2- 4        of subparagraphs (A), (B), or (C) of this paragraph. 
 
  2- 5      A player may be rewarded with both free replays and 
  2- 6      noncash merchandise, prizes, toys, gift certificates, or 
  2- 7      novelties for a single play of the game or device as 
  2- 8      provided in this Code section.  This subsection shall 
  2- 9      not apply, however, to any game or device classified by 
  2-10      the United States government as requiring a federal 
  2-11      gaming stamp under applicable provisions of the Internal 
  2-12      Revenue Code. 
 
  2-13      (2) A player of bona fide coin operated amusement games 
  2-14      or devices described in paragraph (1) of this subsection 
  2-15      may accumulate winnings for the successful play of such 
  2-16      bona fide coin operated amusement games or devices 
  2-17      through either tokens, vouchers, points, or tickets and. 
  2-18      Points may be accrued on the machine or device.  A 
  2-19      player may carry over points on one play to subsequent 
  2-20      plays.  A player may redeem these accumulated tokens, 
  2-21      vouchers, or tickets for noncash merchandise, prizes, 
  2-22      toys, gift certificates, or novelties so long as the 
  2-23      amount of tokens, vouchers, or tickets received earned 
  2-24      on a single play does not exceed $5.00 for a single 
  2-25      play." 
 
  2-26                           SECTION 2. 
 
  2-27  All laws and parts of laws in conflict with this Act are
