                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 40-5-57.1 of the Official Code of 
  1- 2  Georgia Annotated, relating to revocation of drivers' 
  1- 3  licenses of persons under age 21 for certain offenses and 
  1- 4  issuance of new license following revocation, so as to 
  1- 5  provide that revocation for certain offenses shall occur 
  1- 6  only upon a second or subsequent conviction; to repeal 
  1- 7  conflicting laws; and for other purposes. 
 
  1- 8       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 9                           SECTION 1. 
 
  1-10  Code Section 40-5-57.1 of the Official Code of Georgia 
  1-11  Annotated, relating to revocation of drivers' licenses of 
  1-12  persons under age 21 for certain offenses and issuance of 
  1-13  new license following revocation, is amended by striking 
  1-14  subsection (a) and inserting in lieu thereof the following: 
 
  1-15    "(a) Notwithstanding any other provision of this chapter, 
  1-16    the driver's license of any person under 21 years of age 
  1-17    convicted of hit and run or leaving the scene of an 
  1-18    accident in violation of Code Section 40-6-270, racing on 
  1-19    highways or streets, using a motor vehicle in fleeing or 
  1-20    attempting to elude an officer, reckless driving, any 
  1-21    offense for which four or more points are assessable under 
  1-22    subsection (c) of Code Section 40-5-57, purchasing an 
  1-23    alcoholic beverage in violation of paragraph (2) of 
  1-24    subsection (a) of Code Section 3-3-23, violation of 
  1-25    paragraph (3) or (5) of subsection (a) of Code Section 
  1-26    3-3-23, or violation of Code Section 40-6-391, or 
  1-27    convicted for the second or subsequent time of any offense 
  1-28    for which four or more points are assessable under 
  1-29    subsection (c) of Code Section 40-5-57, shall be revoked 
  1-30    by the department as provided by this Code section, and a 
  1-31    driver's license revoked under this subsection shall not 
  1-32    be reinstated. A plea of nolo contendere shall be 
  1-33    considered a conviction for purposes of this subsection. 
  1-34    Notice of revocation shall be given by certified mail, 
  1-35    with return receipt requested; or, in lieu thereof, notice

  2- 1    may be given by personal service upon such person.  Such 
  2- 2    license shall be surrendered within ten days of 
  2- 3    notification of such revocation.  Notice given by 
  2- 4    certified mail with return receipt requested mailed to the 
  2- 5    person's last known address shall be prima-facie evidence 
  2- 6    that such person received the required notice." 
 
  2- 7                           SECTION 2. 
 
  2- 8  All laws and parts of laws in conflict with this Act are
