                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Article 2 of Chapter 7 of Title 48 of the Official 
  1- 2  Code of Georgia Annotated, relating to the imposition, rate, 
  1- 3  and computation of income tax, so as to provide an income 
  1- 4  tax credit for expenses of private driver education for 
  1- 5  minor dependent children of taxpayers; to provide an 
  1- 6  effective date; to provide for applicability; to repeal 
  1- 7  conflicting laws; and for other purposes. 
 
  1- 8       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 9                           SECTION 1. 
 
  1-10  Article 2 of Chapter 7 of Title 48 of the Official Code of 
  1-11  Georgia Annotated, relating to the imposition, rate, and 
  1-12  computation of income tax, is amended by adding immediately 
  1-13  following Code Section 48-7-29.2 a new Code section to be 
  1-14  designated Code Section 48-7-29.3 to read as follows: 
 
  1-15    "48-7-29.3. 
 
  1-16    (a) A taxpayer shall be allowed a credit against the tax 
  1-17    imposed by Code Section 48-7-20 in an amount equivalent to 
  1-18    the amount expended by such taxpayer for a completed 
  1-19    course of driver education for a dependent minor child of 
  1-20    such taxpayer at a private driver training school licensed 
  1-21    by the Department of Public Safety under Chapter 13 of 
  1-22    Title 43, 'The Driver Training School License Act,' except 
  1-23    as otherwise provided by this Code section. 
 
  1-24      (b)(1) The tax credit provided by this Code section 
  1-25      shall be allowed not more than once for each dependent 
  1-26      minor child of a taxpayer. 
 
  1-27      (2) In no event shall the amount of the tax credit 
  1-28      provided by this Code section exceed $150.00 per 
  1-29      dependent minor child of a taxpayer or the taxpayer's 
  1-30      income tax liability, whichever is less. 
 
  1-31    (c) No credit shall be allowed under this Code section 
  1-32    with respect to any driver education expenses either 
  1-33    deducted or subtracted by the taxpayer in arriving at

  2- 1    Georgia taxable net income or with respect to any driver 
  2- 2    education expenses for which amounts were excluded from 
  2- 3    Georgia net taxable income. 
 
  2- 4    (d) No credit shall be allowed under this Code section 
  2- 5    unless the taxpayer submits with the claim for such credit 
  2- 6    written proof of the successful completion of the course 
  2- 7    of driver education by the dependent minor child and the 
  2- 8    amount expended by the taxpayer for such course. 
 
  2- 9    (e) The commissioner shall promulgate any rules and 
  2-10    regulations necessary to implement and administer this 
  2-11    Code section." 
 
  2-12                           SECTION 2. 
 
  2-13  This Act shall become effective on January 1, 2000, and 
  2-14  shall be applicable to all taxable years beginning on or 
  2-15  after January 1, 2000. 
 
  2-16                           SECTION 3. 
 
  2-17  All laws and parts of laws in conflict with this Act are
