                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend an Act providing a new charter for the City of Blue 
  1- 2  Ridge, approved March 21, 1989 (Ga. L. 1989, p. 3823), so as 
  1- 3  to change the corporate limits of the city; to annex 
  1- 4  additional territory; to repeal conflicting laws; and for 
  1- 5  other purposes. 
 
  1- 6       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 7                           SECTION 1. 
 
  1- 8  An Act providing a new charter for the City of Blue Ridge, 
  1- 9  approved March 21, 1989 (Ga. L. 1989, p. 3823), is amended 
  1-10  by adding a new Section 1.11B to read as follows: 
 
  1-11                        "SECTION 1.11B. 
  1-12                Additional corporate boundaries. 
 
  1-13    In addition to the corporate boundaries of the City of 
  1-14    Blue Ridge provided elsewhere in this Act or as provided 
  1-15    pursuant to the authority of the laws of this state, the 
  1-16    corporate limits of said city shall also include the 
  1-17    following: 
 
  1-18      TRACT 'D-1' 
 
  1-19      ALL that tract or parcel of land lying and being in the 
  1-20      8th District and 2nd Section of Fannin County, Georgia, 
  1-21      and being a part of Land Lots No. 241 and 264, and being 
  1-22      more particularly described as follows: 
 
  1-23      BEGINNING at the intersection of the easterly 
  1-24      right-of-way line of County Road No. 103 and the 
  1-25      northerly right-of-way line of County Road No. 90; 
  1-26      thence with the easterly right-of-way line of County 
  1-27      Road No. 103 as follows: N16<09'E a distance of 140.0 
  1-28      feet; N00<53'W a distance of 127.9 feet; N15<51"W a 
  1-29      distance of 174.2 feet; Northerly 80 feet; N36<40'W a 
  1-30      distance of 292.9 feet to a point; thence leaving said 
  1-31      road and running N55<15"E a distance of 25.6 feet to an 
  1-32      iron pin; thence N55<15'E a distance of 248.0 feet to an 
  1-33      iron pin; thence N17<13'W a distance of 297.6 feet to an

  2- 1      iron pin; thence S63<11'W a distance of 85.9 feet to an 
  2- 2      iron pin; thence N00<35'E a distance of 426.9 feet to an 
  2- 3      iron pin on the centerline of an old road; thence with 
  2- 4      the centerline of said old road the following courses 
  2- 5      and distances: S82<09'E a distance of 187.6 feet; 
  2- 6      S74<05'E a distance of 168.0 feet; S74<49'E a distance 
  2- 7      of 182.2 feet; S63<09'E a distance of 170.9 feet; 
  2- 8      S74<50'E a distance of 120.6 feet; N64<31'E a distance 
  2- 9      of 109.8 feet; S77<13'E a distance of 146.9 feet; 
  2-10      S74<53'E a distance of 183.1 feet; S73<05'E a distance 
  2-11      of 147.9 feet; thence continuing with the centerline of 
  2-12      said old road Easterly across the property of L & N 
  2-13      Railroad to a point on the centerline of said old road 
  2-14      located on the easterly right-of-way line of L & N 
  2-15      Railroad Murphy Spur; thence continuing with the 
  2-16      centerline of said old road S68<17'E to the present 
  2-17      northerly right-of-way line of County Road No. 90; 
  2-18      Thence Southwesterly and then Westerly with the present 
  2-19      northerly right-of-way line of said County Road No. 90 
  2-20      to the POINT OF BEGINNING. 
 
  2-21      There is EXCEPTED from the above-described tract of land 
  2-22      that certain parcel of land designated as 'Property 
  2-23      Claimed By Grady E. Farmer' as shown on plat of survey 
  2-24      entitled 'Survey For Fannin County Industrial 
  2-25      Development Authority,' dated May 26, 1989, and revised 
  2-26      August 30, 1989, and prepared by Mike L. Hampton, 
  2-27      G.R.L.S. No. 2452. 
 
  2-28      All bearings and distances, and most other measurements 
  2-29      given in the above description were taken from a plat of 
  2-30      survey entitled 'City of Blue Ridge Industrial Park,' 
  2-31      dated July 28, 1982, and revised April 26, 1985, and 
  2-32      recorded in Plat Book 15, page 45, of the Fannin County 
  2-33      Records. 
 
  2-34      TRACT 'D-2' 
 
  2-35      ALL that tract or parcel of land lying and being in the 
  2-36      8th District and 2nd Section of Fannin County, Georgia, 
  2-37      and being a part of Land Lots No. 240 and 241, and being 
  2-38      more particularly described as follows: 
 
  2-39      BEGINNING at the intersection of the original southern 
  2-40      boundary line of Land Lot No. 241, and the northerly 
  2-41      right-of-way line of County Road No. 90; thence East 
  2-42      with the original line to an iron stake at an old road 
  2-43      near original corner; thence Northeast with the old road

  3- 1      to the first branch; thence up the branch 30 yards, more 
  3- 2      or less, to a marked white oak tree; thence a Northwest 
  3- 3      direction with the William Long conditional line up an 
  3- 4      old wire fence to a marked white oak tree on bank of 
  3- 5      road near house where Luke Elrod now lives; thence 
  3- 6      Southwest with public road on top of ridge to first 
  3- 7      hollow on west side of ridge; thence down the hollow in 
  3- 8      a West direction to the northeast corner of Tract 'D-1' 
  3- 9      described above; thence Southwesterly with the present 
  3-10      northerly right-of-way line of County Road No. 90 to the 
  3-11      POINT OF BEGINNING. 
 
  3-12      The above-described Tract 'D-2' is a portion of that 
  3-13      same property conveyed by warranty deed From Tri-State 
  3-14      Realty Company, Inc. to the City of Blue Ridge, said 
  3-15      warranty deed being dated May 9, 1966, and recorded in 
  3-16      Deed Book 32, page 203-204, of the Fannin County 
  3-17      Records.  Portions of the above description of Tract 
  3-18      'D-2' were taken from description given in said deed. 
 
  3-19      TRACT 'D-3' 
 
  3-20      BEGINNING at the intersection of the northeasterly 
  3-21      boundary of the present corporate limits of Tract 'A' of 
  3-22      the City of Blue Ridge and the easterly right-of-way 
  3-23      line of County Road No. 103 (a/k/a Ada Street); thence 
  3-24      Northerly with the easterly right-of-way line of County 
  3-25      Road No. 103 to the northerly right-of-way line of Farm 
  3-26      Road, said Farm Road being a paved road located inside 
  3-27      the Blue Ridge Industrial Park property, thence Westerly 
  3-28      with a line which is normal to the centerline of County 
  3-29      Road No. 103 to the westerly right-of-way line of County 
  3-30      Road No. 103; thence Southerly with the westerly 
  3-31      right-of-way line of County Road No. 103 to the 
  3-32      northeasterly boundary of the present corporate limits 
  3-33      of Tract 'A' of the City of Blue Ridge; thence 
  3-34      Southeasterly with the said northeasterly boundary of 
  3-35      the present corporate limits of Tract 'A' of the City of 
  3-36      Blue Ridge to the POINT OF BEGINNING. 
 
  3-37      TRACT 'D-4' 
 
  3-38      BEGINNING at the intersection of the northeasterly 
  3-39      boundary of the present corporate limits of Tract 'A' of 
  3-40      the City of Blue Ridge and the easterly right-of-way 
  3-41      line of County Road No. 87 (a/k/a Windy Ridge Road); 
  3-42      thence Northerly with the easterly right-of-way line of 
  3-43      County Road No. 87 to the property line of the City of

  4- 1      Blue Ridge, said property line of the City of Blue Ridge 
  4- 2      being the southern boundary of aforesaid Tract 'D-2' 
  4- 3      described herein; thence Westerly with said property 
  4- 4      line of the City of Blue Ridge to the westerly 
  4- 5      right-of-way line of County Road No. 87; thence 
  4- 6      Southerly with the westerly right-of-way line of said 
  4- 7      County Road No. 87 to the northeasterly boundary of the 
  4- 8      present corporate limits of Tract 'A' of the City of 
  4- 9      Blue Ridge; thence Southeasterly with the said 
  4-10      northeasterly boundary of the present corporate limits 
  4-11      of Tract 'A' of the City of Blue Ridge to the POINT OF 
  4-12      BEGINNING. 
 
  4-13    The corporate boundaries of the City of Blue Ridge shall 
  4-14    also include the following: 
 
  4-15      BEGINNING at the intersection of the centerline of the 
  4-16      Toccoa River and the easterly right-of-way line of 
  4-17      Georgia Highway APD 515; thence Southwesterly and then 
  4-18      Westerly with the southerly right-of-way line of said 
  4-19      Georgia Highway APD 515 to a right-of-way marker located 
  4-20      right 150 feet from centerline station 99+00 (said 
  4-21      right-of-way marker is as shown on Georgia D.O.T. 
  4-22      Right-Of-Way Map, Sheet 8, Project APD-056-2(4) dated 
  4-23      7/25/78 and revised 7/26/82, and said map is 
  4-24      incorporated herein by reference); thence running 
  4-25      Westerly in a straight line to a right-of-way marker 
  4-26      located right 220 feet from centerline station 94+50 
  4-27      (said right-of-way marker is as shown on Georgia D.O.T. 
  4-28      Richt-Of-Way Map, Sheet 8, Project APD-056-2(4) dated 
  4-29      7/25/78 and revised 7/26/82, and said map is 
  4-30      incorporated herein by reference); thence Westerly with 
  4-31      the southerly right-of-way line of said Georgia Highway 
  4-32      APD 515 to the northeasterly boundary of the present 
  4-33      corporate limits of Tract 'A' of the City of Blue Ridge 
  4-34      (said corporate limits of Tract 'A' of the City of Blue 
  4-35      Ridge being fully described in the current City Charter 
  4-36      of the City of Blue Ridge); thence Northwesterly with 
  4-37      the said northeasterly boundary of the present corporate 
  4-38      limits of said Tract 'A' of the City of Blue Ridge to 
  4-39      the northerly right-of-way line of Georgia Highway APD 
  4-40      515; thence Easterly and then Northeasterly with the 
  4-41      northerly right-of-way line of said Georgia Highway APD 
  4-42      515 to the centerline of the Toccoa River; thence 
  4-43      Southeasterly with the centerline of the said Toccoa 
  4-44      River to the POINT OF BEGINNING."

  5- 1                           SECTION 2. 
 
  5- 2  All laws and parts of laws in conflict with this Act are
