A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 31-7-74.3 of the Official Code of
1- 2 Georgia Annotated, relating to the sale or lease of a
1- 3 hospital by a hospital authority, so as to provide that a
1- 4 hospital authority may not sell or lease real property
1- 5 unless a public hearing is held; to provide for the
1- 6 disclosure of certain information; to repeal conflicting
1- 7 laws; and for other purposes.
1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 9 SECTION 1.
1-10 Code Section 31-7-74.3 of the Official Code of Georgia
1-11 Annotated, relating to the sale or lease of a hospital by a
1-12 hospital authority, is amended by inserting at the end
1-13 thereof the following:
1-14 "(d) No real property, other than a hospital which is
1-15 subject to subsection (a) of this Code section, which is
1-16 owned by a hospital authority may be sold or leased to a
1-17 for profit entity, a not for profit entity, or another
1-18 hospital authority unless a public hearing regarding such
1-19 action is held in each county where such real property is
1-20 located at least 60 days prior to such sale or lease
1-21 becoming effective. The hospital authority must publish
1-22 notice of the hearing at least three times, with the first
1-23 such notice appearing at least 60 days prior to the
1-24 hearing, in the legal organ of each county in which the
1-25 real property is located. At each such public hearing,
1-26 the hospital authority shall describe, discuss, or
1-27 otherwise disclose:
1-28 (1) The reasonably foreseeable adverse and beneficial
1-29 effects of such lease or sale upon the area in which the
1-30 real property is located;
1-31 (2) The stated use the prospective purchaser or lessee
1-32 intends for the real property; and

2- 1 (3) The name of the prospective purchaser and, if the
2- 2 prospective purchaser is a corporation or a partnership,
2- 3 the names of the corporate officers or partnership
2- 4 principals."
2- 5 SECTION 2.
2- 6 All laws and parts of laws in conflict with this Act are
2- 7 repealed.
