A RESOLUTION
1- 1 Proposing an amendment to the Constitution so as to provide
1- 2 that certain appropriated state funds will not lapse and may
1- 3 be expended for performance bonuses and other purposes; to
1- 4 provide for the submission of this amendment for
1- 5 ratification or rejection; and for other purposes.
1- 6 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 7 SECTION 1.
1- 8 Article III, Section IX, Paragraph IV of the Constitution is
1- 9 amended by striking subparagraph (c) thereof and inserting
1-10 in its place the following:
1-11 "(c) All appropriated state funds, except for the
1-12 mandatory appropriations required by this Constitution,
1-13 remaining unexpended and not contractually obligated at
1-14 the expiration of such general appropriations Act shall
1-15 lapse, except that one-half of any state department's or
1-16 agency's appropriation which is otherwise required to
1-17 lapse pursuant to this subparagraph shall be retained by
1-18 such department or agency and may be expended for paying
1-19 performance bonuses to employees of such department or
1-20 agency or for any other purpose for which that department
1-21 or agency is authorized to expend state funds."
1-22 SECTION 2.
1-23 The above proposed amendment to the Constitution shall be
1-24 published and submitted as provided in Article X, Section I,
1-25 Paragraph II of the Constitution.
1-26 The ballot submitting the above proposed amendment shall
1-27 have written or printed thereon the following:
1-28 "( ) YES Shall the Constitution be amended so as to
1-29 provide that certain appropriated state funds
1-30 ( ) NO will not lapse and may be expended for
1-31 performance bonuses and other purposes?"
1-32 All persons desiring to vote in favor of ratifying the
1-33 proposed amendment shall vote "Yes." All persons desiring

2- 1 to vote against ratifying the proposed amendment shall vote
2- 2 "No."
2- 3 If such amendment shall be ratified as provided in said
2- 4 Paragraph of the Constitution, it shall become a part of the
2- 5 Constitution of this state.
